3. This happened at CVS. There is a camera that hopefully will show what happened.
4. We have the same insurance, so the adjusters will fight out who is at fault.
5. I work in the same building as the girls mom, I see her everyday. Hopefully if for some reason it comes back as my fault, they won't claim anything cause its minimal damage on her car.
6. I understand many of you will say "you were backing up so its your fault"... I'm not on here to argue my point, but I will say this. The parking lot is L shaped. It was clear of vehicles from my perspective when I was backing up (there was a truck parked on the left side of me), and considering she hit the rear passenger side, that proves that I was just about out of the parking spot. Had she been traveling in her correct lane while on the curve in the parking, she would not have hit me. Also had she not been speeding, she wouldn't have hit me. Attachment 36569
1 question, you were backing up -- were you at a full stop and you were just about ready to go when she plowed you? Meaning that you were already in the drive way and not in the parking lot correct?

If you were at a full stop and she saw you already backed out all the way, then plowed into you, then yeah it's her fault. though from the accident and the look of it, the only way she could have caught it on her skirt is if you were just getting out and she just drove by and you hit her. I'd take pictures of the lot and reference your spots too just in case it comes down to proving you were right.

Here is a PU bumper cover if you are into the TRD one.

Sucks to be hit, hope you get it fixed soon.

From what I can see from the photos and using my awesome internet armchair detective skills, there can only be two scenarios:

1) Cajun was backing out and stopped after noticing the VW lady. VW Lady sees Cajun too late and swerves, clipping Cajun's back end that's sticking out from behind the truck. VW lady definitely at fault.

2) Cajun was backing out but didn't stop after noticing the VW lady. VW Lady sees Cajun too late and swerves, clipping Cajun's moving back end that's sticking out from behind the truck. VW lady and Cajun would both have a share in the blame.

Without concrete proof, it could go either way. This would've never happened if the VW lady had some patience and actually waited for Cajun to completely back out. But nobody ever does that right?

This is the reason why I either reverse park or inch my bum out bit by bit, with pauses in between so I have plenty of time to react and making it glaring obvious to even the best darwin award winners.

I never saw her till I felt the impact.

I was a couple seconds from putting my car in drive, so I definitely didn't just have my ass end sticking out. Way more of my car was in the driveway as opposed to the parking spot.

I saw this earlier- the part about having to cut the bumper to make it fit is a little nerve racking

Please let me know if I'm understanding this right- that black piece that I need replaced (I believe it's called an "apron")... Anyway, that part does not just snap off. It's actually part of the entire bumper??

Yeah that's right. It's made to look like separate pieces but it isn't.

I'd just get your insurer to open a not at fault case and get them to investigate it? At least that's how it works in Aus, they'll go into battle for you.

Yea but we both have the same insurance. So it's basically gonna be who gets to claim on whose policy, or 50/50

By a body shop. Jk, though I still think you should file a claim.

Sorry this happened to you - but just to be safe, I recommend a few things:

1) Any eye witnesses? Get their contact info and statement. No witnesses? Check for any video recording equipment that businesses may have had. If they offer it up for free, great, if they charge for it, get a receipt so you can get reimbursed by insurance.

2) Go to the police and file a walk-in accident report. Even though the accident was on private property, it's best to have a report filed.

3) Contact your insurance company to let them know what happened. Even if you don't file a claim on your own policy, you want them to be on notice in case the other party decides to make a claim against your policy, even if its the same carrier.

What you do from here depends on if you want to make a claim against the other party's policy, your own, or just pay for it out of pocket. Either way you take, make sure you did the above suggestions. I understand you may want to avoid taking a claim against your own policy, but you have no guarantee that the other party won't.

I saw a post of $800 for a rear repair... I damaged my bumper cover and I have to replace it to fix the small dent I have (didn't even affect the paint). I was quoted just over $600 for my BRZ's replacement here in TN by one of the best repair shops in town. With that price difference be sure to do some research for your area!
