Sucks to be hit, hope you get it fixed soon.
From what I can see from the photos and using my awesome internet armchair detective skills, there can only be two scenarios: 1) Cajun was backing out and stopped after noticing the VW lady. VW Lady sees Cajun too late and swerves, clipping Cajun's back end that's sticking out from behind the truck. VW lady definitely at fault. 2) Cajun was backing out but didn't stop after noticing the VW lady. VW Lady sees Cajun too late and swerves, clipping Cajun's moving back end that's sticking out from behind the truck. VW lady and Cajun would both have a share in the blame. Without concrete proof, it could go either way. This would've never happened if the VW lady had some patience and actually waited for Cajun to completely back out. But nobody ever does that right? This is the reason why I either reverse park or inch my bum out bit by bit, with pauses in between so I have plenty of time to react and making it glaring obvious to even the best darwin award winners. |

I never saw her till I felt the impact.
I was a couple seconds from putting my car in drive, so I definitely didn't just have my ass end sticking out. Way more of my car was in the driveway as opposed to the parking spot. |

Yeah that's right. It's made to look like separate pieces but it isn't.
I'd just get your insurer to open a not at fault case and get them to investigate it? At least that's how it works in Aus, they'll go into battle for you.

Yea but we both have the same insurance. So it's basically gonna be who gets to claim on whose policy, or 50/50

Sorry this happened to you - but just to be safe, I recommend a few things:
1) Any eye witnesses? Get their contact info and statement. No witnesses? Check for any video recording equipment that businesses may have had. If they offer it up for free, great, if they charge for it, get a receipt so you can get reimbursed by insurance. 2) Go to the police and file a walk-in accident report. Even though the accident was on private property, it's best to have a report filed. 3) Contact your insurance company to let them know what happened. Even if you don't file a claim on your own policy, you want them to be on notice in case the other party decides to make a claim against your policy, even if its the same carrier. What you do from here depends on if you want to make a claim against the other party's policy, your own, or just pay for it out of pocket. Either way you take, make sure you did the above suggestions. I understand you may want to avoid taking a claim against your own policy, but you have no guarantee that the other party won't. |

I saw a post of $800 for a rear repair... I damaged my bumper cover and I have to replace it to fix the small dent I have (didn't even affect the paint). I was quoted just over $600 for my BRZ's replacement here in TN by one of the best repair shops in town. With that price difference be sure to do some research for your area!
