At that point you are not modifying the cat back you are completely removing it. I'm no expert in California emissions laws but I'm fairly certain they will not let you run a straight pipe from the cats back and it pass inspection.

V.C. 27151 No person shall modify the exhaust system of a motor vehicle in a manner which will amplify or increase the noise emitted by the motor of such vehicle so that the vehicle is not in compliance with the provisions of Section 27150 or exceeds the noise limits established for the type of vehicle in Article 2.5(commencing with Section 27200) of this chapter. (b) Except as provided in Division 16.5 (commencing with Section 38000) with respect to off-highway motor vehicles subject to identification, every passenger vehicle operated off the highways shall at all times be equipped with an adequate muffler in constant operation and proper maintained so as to meet the requirements of Article 2.5 (commencing with Section 27200), and no muffler or exhaust system shall be equipped with a cutout, bypass, or similar device. (c) The provision of subdivision (b) shall not be applicable to passenger vehicles being operated off the highways in an organized racing or competitive event conducted under the auspices of a recognized sanctioning body or by permit issued by the local governmental authority having jurisdiction.




Part (a) states that the muffler must suppress any excessive or unusual noise. This refers to part (b) which states that the muffler must meet the requirements of Article 2.5, which refers to noise levels. Part (a) and (b) also refer to a cut-away, bypass or similar device commonly known as a "dump."

The only purpose the exhaust serves after the catalytic converts is to direct exhaust gases away from the cabin of the vehicle and to reduce sound to reasonable levels.

The Fiat Abarth is running a straight pipe from the factory post-cat.
One of the family cars is running a straight pipe post cat as well, family member worked for the BAR smog department, shouldn't be any issues.

I copied my info from the link you had posted lol. Seems like it would be to the discretion of the officer involved as the car does not come that way from the manufacture then it would be interpreted as "modified" and fall under the segment that I copied and pasted.

I honestly can't even think of what the exhaust would sound like with that weird gap, because I can't imagine why anyone would do that. If you want it to be louder for cheap, just get a muffler delete.

Also, I'd stop going to that dealership for service if they're employing mechanics who would suggest that.

Never done it on purpose nor had it happen to a boxer engine but generally when my cars had the pipe rot off before the muffler and leave a gap like that the sound was sort of like

Yeah, I kinda guessed it'd just sound like a car with a hole in the exhaust. Which sounds terrible.
