If you are assuming it is the other drivers fault, I think you are correct. No debate there. I think only if it's OP's fault will it matter regarding the aftermarket parts. I think some insurances require additional coverage for aftermarket parts that add to the cost/value. This way the car is adequately insured.

I don't think OP has conveyed the entire thing. We all start jumping to conclusions, lol. Which is why I said the questions he has are better answered by his insurance company.

BTW, situations like this always require a reminder:

If you value your aftermarket parts and want to protect it, make sure your insurance company knows about it.

To not inform them and try to claim coverage when the policy excludes specific mods is fraud.

Yeah ive already filed a claim with my insurance. They said they are still investigating who is at fault. Idk why when its pretty obvious. But anyway do i need to contact his insurance company or will they eventually contact me? I am also supposed to get reimbursed from them for this rental im driving.

Your insurance should pretty much handle all of it. Your insurance will try to get the story from you as well to make sure everything is consistent. Just protocol. I've had it happen to me, but I was hit from the side.

I hope you get everything that is owed to you. If you can get disminished value that would be even better. Sometimes accidents happen, but I know I would be a little upset initially. I got over it though.

What makes you think the frame is bent?
As far as the exhaust goes I could probably kick it in that far. Doesn't even look like it snapped the hangers.

Well i guess it looks worse in person than the pictures. But hey im expecting the worse and hoping for the best. I hope you guys are right and its not totalled. Ill updats you guys on what they say tomorrow

I didn't read the whole thread but the damage isn't that bad. Since it'll be their insurance covering it, they should cover all parts damaged(same as if they hit your house or drove thru your fence which obviously isn't covered under your auto insurance). If it was your insurance they would just pay for stock

In Florida if an aftermarket part is in a factory location, it is covered, by either yours or theirs depending on fault. I have had aftermarket stereos stolen years ago...They were covered since they were in a factory location. You were rear ended, their insurance should cover everything, including a rental while your car is getting repaired.

All depends on the insurance company. Usaa was happy to replace everything that was aftermarket for me. I just had to bring proof of purchase. They even gave me the benefit of the doubt on my used parts with no receipts.

I am not out of the clear yet, (have not taken delivery) But I am confident that i will not be getting screwed... at least by usaa.... i am on the fence abiut the body shop.

Florida dude here chiming in.

The other driver is at fault no matter what in FL. If you get rear ended in FL it's always their fault for not leaving enough room even if they brake check you.

Insurance should cover the aftermarket part to replace or write you off a check equaling how much the aftermarket part costs. I had my valenti lights on for 3 months and my car got hit while parked in a hit and run.


When you take your car into the insurance adjuster for them to assess the estimate of the damage, ask them if you don't believe me since that's where I got my answers from.
