If the accident is your fault in the eyes of insurance, then you are the one (in their eyes) who diminished the value of your own vehicle.

It may be worth a shot if the other guy's insurance were paying for this, but any extra nickel you get out of the insurance company today is going to cost you a dime in the long run.

It pains me to see all this damage. Sorry to the few and high hopes insurance doesn't hose ya. I see this on a daily basis heading eastbound I10E and the 110n or s split. Ive had at least had 5 close calls and I was so glad I never committed to lane change. Your signal maybe on, you may be doing everything right, but the other d'bags around don't give a shit and probably don't have insurance. I don't know if its just me, old age, etc.. but I see a shitload of cars in downtown LA with this kind of damage. Hopefully soon you'll be back in your BRZ. Rant over

If you change lanes and there is an incident, it's always your fault. Doubly so that you hit their car with the side of your car. Take this as a lesson and use your mirrors better and yield properly. It might not seem fair in your eyes but thems the rules.

Unfortunately quite true. I'm always amazed with the inflexible, cut-n-dry nature of some traffic laws. If the op had changed lanes even quicker and completed the lane change before getting hit then I suppose it would be a 'hit from behind' scenario and the op would not be at fault..?

Use a shop. If its an insurance approved shop, the repairs are guaranteed for the life of the car.

This used to be a common insurance scam in the 70s. An asshole would swerve in front of another car, slam on the brakes and then pretend to be injured. The cops would arrive on the scene of a rear end collision and automatically find the rear driver at fault.

Insurance companies got wise to it first when they started seeing the same people filing claims for the same type of accident. Then cops started actually paying more attention to witnesses when some states ramped up prosecution of insurance fraud.

Now, if you have a dash cam and someone pulls that shit, you have evidence that they caused the accident. What would have been an automatic fault for you turns into a citation for the other driver for unsafe lane change, and their insurance ends up paying.

Ain't technology grand?

It would be mostly he said she said. Would depend on what other evidence there was (ie witnesses, video, police report). If there is evidence then the one doing the cutting off (ie op) would still be at fault.

So update, they put it 60/40 at fault mainly hers which is nice. The body shop finally has it and finished the estimate. The damage came out to 16k!!!! The insurance company wont total it as its value at 23k. It will be done on Jan 31


Edit: I fought my ticket and ended up getting it dismissed as she actually also received a ticket, two in fact. I did not know at the time as she went to the hospital as "precaution" so the officer couldn't write her a ticket. I found out at court that due to several eye witness account the officer wrote her two tickets one for excessive acceleration and failure to yield. Im not sure why she received the second one as what justifies I have the right of way but needless to say this is why the insurance didn't put me at fault. Thank you USAA
