I cannot imagine Stewart needing to pay. Ward ran out of his car into the middle of a dirt track. If somebody ran in front of me on the freeway and I hit them, I would not be liable.

No you would not, however, the next 6 months of your life would be a living Hell dealing with paper work, lawsuits, media & press coverage, etc.

Heard lots of stories about dirt racers and pit crew drinking and smoking in the pits before a race. Wouldn't surprise me if half of that grid had something in their system

He's been found innocent of actually causing the death in criminal court, but they can sue him for emotional trauma or something like that in civil court, which has a much lower burden of proof. It'll end up being easier and more positive/less negative publicity for Stewart just to settle out of court. So whether he needs to pay them or not, I imagine he will pay.

I'd bet Stewart's already taking care of the Ward's.

If I know anything about families grooming kids for racing, then the odds are that this kid was no breadwinner and it seems like the family is milking him for all he's worth now:

Our son got out of his car during caution when the race was suspended. All the other vehicles were reducing speed and not accelerating except for Stewart, who intentionally tried to intimidate Kevin by accelerating and sliding his car toward him, causing the tragedy. The focus should be on the actions of Mr. Stewart. This matter is not at rest and we will pursue all remedies in fairness to Kevin.

For every Jeff Gordon, Joey Logano and Bryan Clauson there are hundreds of drivers who crossed the finish line ahead of them at one point or another that you will never hear of. I sincerely hope that they (Ward + Stewart) let the matter rest and settle their differences behind closed doors.

Hopefully this never happens again.

Really, Tony Stewart would have every right to sue the Wards.

Their son has cause him emotional and financial stress.

If I was Tony Stewart, I would NOT settle out of court (but I feel he will) because that is almost an admission of guilt.

If Ward's family want to be major assholes, they can. However, after a grand jury refuses to press charges, a civil case is going to look pretty shitty on the Ward family. They likely just want to move on. Course, if Ward was too stupid to stay in his car, he might have been too stupid to get life insurance.

Let's flip the coin. How about, knowing the facts that Ward run out on the track in the dark with a black racing suit on and had MJ in his system. How about Tony suing the Ward family for Mental Anguish considering the trauma it has caused him and his future racing career? How's that for looking at the other side of the coin?

That would reinforce many people's opinion that TS is an asshole. He would never do that IMO (nor should he, his career vs a life is a hard argument to make).

I agree with you Dave...

But Dale Jr was involved in a lawsuit with his Step Mom over his Dad's enterprise...

So being cutthroat is fairly common in racing.

I think Tony should only counter sue if his (Ward's) family sues him.

He doesn't have to go after money, he could just sue to shut them down and prevent future suits.

I understand the Wards being sad about their boy. But you can't just sue someone everytime something bad happens (and I know you agree with that statement).
