I am concerned that the car has been in an accident. I've asked Subaru if there is any "history" and if the trunk lid should have a security label (Subarus in the UK have them on the doors to deter "steal and sell for parts"). No reply to either question.

I can't believe sealant can be missing - if it's missed once it must have been missed many times. Ford in the UK refused water leaks warranty claims after 12 months on Focus hatchbacks and a dealer found a cure at a cost of over $1000 - strip all trim down to the top of the doors and seal all seams. They were doing good business until a German speaker did an internet search on a German Ford forum and found that all that was required was to pull down trim at the back of the roof and seal the 2" at the back of each tailgate hinge (too much trouble to lean into the back ?). 10 minute job.

I guess previous damage is possible, but if it happened, it most likely happened in the factory and won't show up on any history. For this part of the car to be damaged, it would have taken a major collision. The rear quarters which run up the C-pillar would have to have been cut out and replaced, broken rear windshield. That center panel looks like it welds to, or is the rear package tray, which means cabin damage. I don't see any sealant residue, so the panel would have to have been replaced completely. But the paint on the inside looks a little scratched up, and I can't tell if those two small holes (Left of the trunk light inside the trunk) are supposed to be there or if those are spot welds that have been drilled out, I'll have to check my car in the morning. I'll try to look at the over spray on the inside of the trunk and see if it looks like your spray pattern. I am pretty sure the factory will cover this under warranty, even if it will be a hassle to have it fixed.

I went out and took a quick look at mine, that area is completely sealed off, no gap. I think that's your problem. Also, not sure if it's the same on UK cars, but there is a VIN tag on the trunk (boot?) lid just below the rubber wiring insulator between the body and lid.

If you intend to keep the car, I suggest you buy a tube of clear weatherstrip sealant and a caulk gun. Clean the area with a towel and denatured alcohol, dry it thoroughly, then cut the tip of the sealant tube small enough to work it into the gaps.

Based on that pic it looks like you will need warranty work to seal that up. Good luck!
