Yea... That what I might do..

Aluminum is pretty damn hard to fix if there is buckling. It means there is like dents on it right?

So basically what they told me is that they will cut apart everything on the back of the car, and put all new sheet metal.
Wouldn't the structural integreity of the car be like... Completely ruined?

Do not accept a 500 mile car with that kind of damage back. On top of diminished value, you are right in that the metal will be weaker. I don't care what any body shop says. They are never the same. I had an NSX that popped randomly and nobody could find it. The previous owner slid it sideways into a curb. They replaced $16,000 worth of suspension, but it never was right. 73% on a one or two year old car is one thing. This was a new car

Also, they are required to pay the price of the car plus tax and dealer fees. You should not settle for anything less than a new car at no expense to you. Be firm about that.

Well.... Insurance is using Virginia laws. They will not total the car unless it exceeds 75% which pisses me off pretty bad.
If i don't accept it, I get nothing..
I think I might get the car fixed, file a diminished value, sell it, get a new FRS.

75% on a 5 year vehicle, no biggie, not a lot of damage.
75% on a 2014 car ... BIG BIGGIE.

OP, I understand that you're upset that your insurance company is not writing your car off as a total loss, but that's a risk you take having insurance on property--it's their call and they're making it from a purely financial standpoint. Be glad that you have insurance on the car and that they're going to fix it. Or don't fix it and take the check, sell the car, and buy a new FRS.

Have you at least spoken to a reputable attorney?? The initial consultation is always free, speak to a couple and see what they can do.. Doesn't matter how expensive the attorney cost as they take it out of the insurance end. They may be able to get it all figured out. Georgia laws are different, but I had a friend in a two month old CX-7 and someone had a accident on the other side of the highway, when the person hit the k-rail all the lugage flew off the top and he hit it going the opposite way, 7 cars total in the incedent and his was the newest car. They didn't/couldn't repair it properly as she didn't have enough coverage, so his insurance took over and after a huge fight because they just wanted to repaint the front end, and fix the trans cooler, he was able to get new front sheet metal, whole car repaint and new trans cooler.. All because he finally called a lawyer.. Also it went from weeks and weeks of messing around, to less then a week after the attorney got involved.. So maybe just speaking to one might help

Thanks, but his insurance has enough coverage to fix my car... I just don't want it fixed, and total my car..

I'll keep you guys updated tomorrow after they give me the price. Maybe I may get lucky and BOOOOOOOOOM TOTALEDDD!

I'm sorry that's what I meant, take to one to make sure they total it, that you feel unsafe in the car due to the damage.. I just brought up the past experience because it was no time at all after the attorney contacted them that it was to my friends standard.. I'm sure if need be an attorney could help if it came down to it.. Just if your not satisfied with what they tell you. Maybe it wouldn't hurt to call one and see

He wasn't saying they'd fix it, the key points were these:
- Lawyer's are free to consult to see if they're help: doesn't hurt to call one.
- Lawyer's costs will be covered by the other person's insurance, no cost to you.
- In his experience, what was a long and complicated insurance discussion over multiple weeks was suddenly resolved in a week with person making the claim getting what they wanted the moment they called a Lawyer.

Probably because when an insurance company is covering a lawyers fees on top of whatever they're paying you, it's cheaper to just offer you more instead of dragging their heels.

Point is: Call a lawyer, it'll be free and they'll tell you if they can help.

Repair is almost $12,000.

That's far from 75%.
If you are inattentive on the road, please get off the road so you don't mess up someone else property.

That sucks. I would get one more quote from an import shop that works on high end cars like Porsche, Audio, BMW, etc.

Call up your local Porsche dealer and ask where they get their bodywork done..

I would, but the problem is that I'm only around the 40-45% mark... Long way to hit 75%.. If my car was at 60% 65%, no problem..

I guess my only option now is to file diminished value, sell the car, and get a new frs.

There are lots of people here that work on cars for a living. Why not post scans or pics of the estimate to see if there's some wiggle room?
