Sigh.. Totaled or not?
 
I got rear ended on the highway today with traffic. He claimed he rear ended me at 40mph, but know sure if hes lying or not.. Just wondering if my car is totaled or not. I honestly don't know how you rear end someone when I've been stopped for a good 10 seconds.

Just from the pictures it's hard to tell without actually seeing it in person. However judging form the photos you've given, I would say yes that it looks to be totaled.

It's a 2014 Scion FR-S. 512 Miles I believe. Only 3 weeks old. Got my perm plates today, and someone rear ended me 20 minutes later. Doors open and close properly.. But I can't put it in Park or Reverse. Only neutral and Drive.. Problem is, Idk if they will total it or not... The front looks good. Only the back side and some of side damage.

40ish mph looks about right. Look at my total, I was doing 40-45 and mine looks like a crushed soda can. It is aluminum and this car absorbs impact very well.
If it isn't a total loss it will be close. They have been quick to total our cars but it's for the best really. Someone else said it, it will never be the same.
So sorry it happened though and make sure you get medical attention. Whip lash is no joke.

Currently, I feel no pain.

Anyone know how long it takes for insurance company to finish everything? From totaling(maybe) to a new car?

Looks like it might have hurt...by morning you might be stiff. Don't tell the insurance company "no injuries" just yet. They can wait for that answer, there is no hurry for them to have it now.

Depending on whether you accept their first offer which almost certainly will be lowball, it could take as little as a week or as long as 2 months if you keep refusing their offers.

In the meantime, you should have at least 30 days of rental coverage from the assholes insurance company while you wait. If you need one longer, ask your insurance about that.

You won't get a new car, technically yours is used. They will rate it as such. Of course there should be zero doubt that the car was absolutely mint condition considering you just got the damn plate that day. Regardless, you're going to lose probably $1k or more.

I'm sure there is a way to make back the small loss.

I did when my Civic was stolen, took 61 days and would have kept going had I not finally agreed(adding hundreds $$ each time).

If you think about it, if you aren't accepting, they aren't paying. I imagine they wouldn't care if you took years, although I'm sure there is a time limit of at least a year or two.

What he said...sore as fuck first few days after either way go the hospital. Insurance will cover all medical. Go to the hospital within 3 days and tell them you were in a car accident and need to get checked out. If you don't do that and injuries pop up later down the road you will be responsible not ins. Better to be safe then on pain management for life.

Mine happened 4 days before Xmas. With holidays it took 2 weeks open to close for me. It all depends on your negotiations. Your car was so new you are in a better position to negotiate.

It will depend on the cost to repair the damage. My paperwork said it would cost 28k to repair my car and my acv (actual cash value) was 24k. Not worth it to them to repair so it was totaled. I had 20k miles and bought it sept 2012.
Ps. I had 10k in mods on mine so I bought it back
