Mudflaps scratched the paint!!

I has a set of OEM mud flaps installed by the dealership I bought from before I picked the car up. I bought it in March 13'. It's been about 7 months and the other day I noticed the two front flaps were loose. After I examined them I found out the bottom screws weren't connected to the fender and it caused the flap to move freely which then scratched up the fender and rocker to the point it's through the paint. I need to to take it in and have it looked at but do you guys think that's grounds for a warranty issue or least my dealerships fault? Because last thing I want to do is spend $600-$800 for paint work.

Yes, of course it's a warranty issue. The paint warranty may be voided, due to either dealer negligence and/or a badly designed flap.
