i dont think it should matter if you talked to your insurance about your aftermarket parts or not since you weren't at fault.

any loss on your part should be covered by the party at fault.

I could be wrong though but that just makes sense.

nope they only do that if the car is apprised.... When my first MR2 (wide-body with lots of mods) burned to the ground they gave me 6k when i had over 15k in parts/labor into it. Then when my 240 was stolen they gave me the KBB value and got screwed out of what little money i put into that too.

Wow, if he was going anywhere near that fast, the car held up well.

I'm glad that you're not too seriously hurt...but as someone who's been through a fairly bad rear-end accident, you will have neck and back pain as a result...it is only a matter of time.

Getting the car checked out and made right again will be a struggle because insurance companies try to nickel and dime their way out of so much...all I can say is, do not take custody of your car from the body shop until you feel all repairs have been performed satisfactorily.

Case in point: Several years ago my Eclipse was sideswiped by a Suburban and in addition to the serious cosmetic damage, there was damage to the suspension, steering, a newly concaved wheel, and all types of stuff. Well, the body shop did a great job of fixing the body and matching the paint, but the car just felt loose and sloppy, and it vibrated a lot.

The shop kept assuring me that mechanically the car was sound because it had been checked out from top to bottom. Well, there were two motor mounts busted that I had to point out to them. I told the body shop and the other person's insurance to fix the car properly, and I wouldn't accept the car until it was brought back to its condition before the accident.

It sucked waiting a a couple of days longer, but I'm glad I did.

Complete and entirely different scenario. Your insurance company vs another individual's. Legally, this makes a huge difference. You sign a contract with your insurance company. Another company? Sky is the damn limit (well, technically the policy limit is the limit, and then you start taking assets). Get an appraisal, send a certified letter to the guy who hit you for a stated amount, and then sue if the insurance company does not pay the excess. You absolutely do not need to accept KBB from another party's insurance company ever.

You have to go after the driver separately for the mods. If he is at fault they are required to return the car to the same condition it was in

Have towed to your house after accident in a place you can take mods on/off. Then tow to place to get repaired.

1> It's a whole different ball-game when someone hit you. You have very particular limits of liability with your insurance, so they may balk about mods. However, when you're not at fault, the other guy's insurance is going to pay out to make you whole on every last dime -- mods included. Your only worry may be if he didn't have insurance, or his coverage limits were more than your mods (not a concern here). You have absolutely nothing to worry about in this case. The only thing you may have to do if the mods are damaged is furnish the company with a receipt and/or a replacement cost. It's very easy.

2> In regards to an issue where you were being covered by your own insurance (which does not apply here at all, just an FYI), if you were at fault for example, you need to purchase seperate coverage if you wish for your mods to be covered. When you pay a rate, you pay a rate for a car that's fully-stock, with a set value. You can't go and put $20,000 into your car and expect them to cover it when you've been paying the rates of someone with a bone-stock car. You've changed their liability, therefore you need to pay more.

Most insurance companies, in most states, provide additional coverage usually called "Custom Parts and Equipment". If you are modifying your car, you better buy this coverage. It costs almost nothing. Mine is something like $1 every 6 months for each $1,000 of coverage. 3 insurers I've dealt with in the past limit their coverage to $5000 on straight optional CP&E coverage. Anything beyond that and you will need to get your car appraised so they can provide a more accurate quote.

Be very, very aware that some companies can either hike your rates up dramatically if you go beyond the started CP&E coverage and move into "specialized" custom appraisal insurance rates. There's also the risk of them dropping you if your car is too heavily modified and deemed unsafe. Usually you can pick one of your choosing, but if they make you take it to one of theirs, I'd be wary of what gets reported to them. I've heard many, many stories of GEICO dropping people for nearly anything; Progressive will not insure any vehicle with suspension modifications.

I actually saw your car today. I stopped by the body shop to pick up one of our fleet cars and saw it parked there. That sucks man. Hope you get everything sorted out.

I am pretty sure you have neck pain and back pain right now. Sue my friend sue regardless of what the guy who hit you said, the hit was bad by looking at the pictures , the ass was probably on the phone :/.

im going in tomorrow to talk to my claim agent and to get it inspected and such. I still haven't heard from his insurance though im going to call them tomorrow too.

In my experience, your own insurance company will only fight on your behalf up to the point their potential liability ends. After that, they really do not care.
