Car needs a new transmission but Subaru wont cover it under warranty..

Hey guys,

Need some advice. My car needs a new transmission because of gears grinding on 6th. Subaru will not warrant it because my car is "fully catless" and they are blaming the extra power being the cause of my transmission failing. So they've flagged my car in southern California... They told me the cost to replace it would be around $7000!

If you were me, what would you do? Need as much advice as possible on this. Honestly don't think that its really fair, to consider such a modification to even be able to do that.

Look for used transmission, there's few posts on Fb and u might find some here, people who have done engine swaps. Or rebuild it else where never go to dealer unless ur car is stock.

Which dealership did you go to? Did they specifically say you were flagged?

Your sig says youre supercharged as well... Hopefully you disconnected all that prior! haha

I feel like the supercharger would be more of a concern than a lack of cats. That is my logical approach to it, anyway.

They did tell me my vehicle got flagged, there was a corporate rep visit today. And I did take off the supercharger. But I left the car catless.

Lesson learned, I just didn't think they would pin the reasoning on having no cats..

don't they have to prove that the "extra power" actually caused the problem? cuz what did that give you? 2-5 hp? lol

doesn't the Magnuson–Moss act come into affect for this situation?

as far as I know about this denial of warranty issue is that the dealership can deny warranty services for anything. it is up to the customer to PROVE that the dealership is wrong in their denial of warranty. and the only way to prove it is through the courts, or a call to the higher ups (good luck with that)

It doesn't matter, dealer will find any reason not to do free repair. Its like when u get pulled over for nothing but cop has to give u ticket so hell find something. Only time dealer will warranty is when u haven't done nothing to the car and daily drive the car.
Also remember car logs highest rev and saves it in ecu. If you red lined the car they will know and it voids drivetrain warranty

getting a ticket from a random spot check by a cop is different. He has every right to ask you to pop your hood and check for illegal parts and ticket you if that part is technically illegal. The OP's situation is that he's being denied warranty for something that isn't directly correlated to the issue. they're literally bullshitting him to save themselves the cost of repairs.

Do you think this would still apply to me? They told me the reasoning behind my gear grinding is because of the, "increased power from not having any catalytic converters caused the synchros to become defective" (something like that) which is total bs.

They gave a reason why the aftermarket part was causing the defect. In your case you could probably fight them on it and win. But that would involve lawyers hiring an expert to argue your cause and days out of your schedule.

You would save money just going out and getting a used transmission or even a new one.

Since you already took the car to attempt warranty and there are documented mods that SOA is using to deny a claim, basically it is a lawyer situation.

You have to get them to prove that your mods contributed to the powertrain failure.

But honestly, this could've been avoided if you had 1) a better relationship with the dealer, or 2) taken off ALL engine-related mods. If you are doing things beyond the rated torque capacity of the transmission, that's a very good reason to deny warranty coverage on the transmission.

Their reasoning is BS but valid. Up to you if you want to hire a lawyer for this or not...

If I were you, I'd forget the dealer, doubtful you'll make any headway and a lawyer will end up costing you more.

If I were in your shoes, I would buy a used transmission, swap it in with a buddy, then either sell current transmission as is, or replace the 6th gear synchro myself and sell it for what I have in the used transmission. Not out anything but time and effort and minimal downtime.

If you can't afford that at the moment and don't have another car, drive the car until you do, avoiding 6th gear, if you continue to use it with bad synchro a you'll take chunks out of the gear and wind up replacing it as well. You'll get bad mileage on the highway, but as long as you aren't doing 80-85 on a regular basis... 5th gear will get the job done
