Another total or non totaled =(

To make a long story short I just got promoted at work a month ago and decided to finally buy myself a sports car that I always dreamed of having. I bought a 2016 frs ablaze and after 400 miles some dipshit hit me while I was stopped at a red light going about 50 mph. I have researched similar topics for hours but I was wondering if any of you would offer an opinion if you see anything to think this might have a shot at getting totaled?

I am at a loss for words, to make matters worse my last car had 15k in damage caused by a drunk driver while it was parked.

Thanks for any help!

Mine had almost the same damage on it and it was fine. My rear fender wasnt touched though so that might play into it?

Not totaled. You may have dodged a bullet here. Your rear bumper and trunk did their jobs. There will be some frame damage, but nothing that cant be straightened out. I'll guess you're around $7500 damage here. It'll fix up and drive nice. If I'm wrong, internet points I surrender.

Kind of related question. Both myself and the idiot both have progressive insurance....this is bad right? Am I right to assume I should be offered some sort of compensation for a severe loss in value? Am I going to be screwed because are both progressive customers?

Ah, Florida drivers. That car looks a lot like the 2016 MX-5 that got hit by some drunk in a F-150 1 mile from pulling out of the dealership in Jacksonville after buying it.

They will probably fix it but you would be better of if they totaled it and you got a new one.

Sorry.

You should be made whole for your loss. You may have to fight for your rights a bit.

I don't know much about insurance so how exactly does it work? I always thought you go get the car fixed and if the accident was not your fault the other guys insurance pays what you payed to fix the car. Or does it work different?

Do you own it outright or do you have a loan?

That is indeed the case, however now that there has been significant structural damage to my car the value is going to be diminished greatly when I go to sell or trade it in. As soon as a carfax report is pulled and they see the entirely of the damage my car will be worth thousands less than it rightfully should. Either way it sounds like im screwed.

The insurance company will pay the repair shop directly.

Diminished value is what you are hoping to claim. There and many formulas but the best recourse is an independent appraisal of the vehicle. I got F-d around by that lizard company and ended up settling for less than I felt fair diminished value (personal injury lawyer didn't want to mess with it). Similar looking damage to yours and the rear cross-member had to be replaced too (exhaust was shoved into it and dented it)

Now would be a good time to talk to the shop and line up some fancy taillight and exhaust use the allowed money from the claim to cover most of the cost...

Looks like it's fixable. A good shop should fix it up nice. Trunk and bumper too most of the damage.
If the insurance says it's totaled, always reject the first offer on the value of your car. They are trained to give you their lowest offer. The third offer is usually the correct market value.
