I was in a hit and run 3 months ago. In total there was 12 grand in rear end damage. My car was completely restored and I got 4 thousand dollars for diminished value in my pocket.

So I'm a jerk because I sued someone for hitting me? For "using" the system? I guess I could have just let insurance take care of it, which was the initial plan.. But then he tried saying it was my fault, then tried to sue me "FIRST" because of air bag residue. So, I countered. Sueing actually didn't cross my mind until I was served by him first.

A. We don't know what your situation was after the accident. Such as actual wages lost, economic condition.
B. counter suing is ok seeing as you were only defending yourself from what sounds like a frivolous law suit that was filed against you.

Did you mention it in the first post?

If you're at fault the lesson is don't sue. You'll most likely end up owing more than what your insureance will go up.

I didn't mention it... And probably should have. Now everyone thinks I'm a ****. Lol, oh well. I've never ever thought of sueing someone caused by a car accident until it happened to me. And when I was hit by that guy, it still didn't cross my mind at the time. Until after he served me.

If you sued them simply because they hit you...yes, you are a jerk.

If you counter-sued, then it's ok, since the other person was trying some BS first. You needed to teach them a lesson. Details would've been good the first time you told the story though.
