Wow they must be getting a lot better I have never dealt with Geico but the others ones I've had experience with either myself or helping a friend it was always a long process of the appraisal, police reports, and processing the payment.

My son wrapped our Envoy around a tree on a Monday and we had check in hand by Thursday. I got more on the payout than I would have received by selling it so it was both fast and fair.

I work as an adjuster right now and our deadline is to get a total loss paid out within 7 days. Typically the only reason it takes any longer than that is communication issues with the owner or difficulty coordinating getting paperwork signed.

Like whaap mentioned, it's all about the individual adjuster; if you have an adjuster that doesn't really give a crap about doing a good job, then you'll have a lousy time.

The messed up part is that even though I didn't hit anyone and wasn't cited in the accident my insurance has gone up $40/month for 3 years just for filing a claim. Mind you the accident took place in California and I live in Florida now and its causing a rate increase for another 6 months. Ridiculous.

The driver of the rear car will be responsible only if the 3 stories prove him at fault. For instance the driver of the front car would have to say that he was hit twice for your story to be accurate. If you hit the front car first then the rear driver would only be responsible for damage to your car for following too closely. In some states they have no-fault insurance laws and in this scenario everyone pays their own damage (not sure TX/CA rules for this). Did the front driver make a statement to the effect to the officer, collaborating your version? Was it noted on the police report?

If your car is totalled you will get market value in most states, GAP is only for lien holder scenarios.

It seems you are unharmed so I wouldn't bother to contact an attorney unless you're not getting payment or you're asked to give a formal statement to someone else's attorney.

This happened to me back in 2007. I was sitting at a red light and a guy in a cell phone didn't notice and plowed into the back of my car pushing me into the intersection. Called police, they charged him and wrote up the report and gave me a copy. Report shows I was not at fault. Car was 1 yeAr old. Insurrance covered the cost of the car.

Well.. Maybe not sue. But you should have atleast 2 years to get treated, or file a claim to sue, which could get you a decent amount.

Well if they screw you over with the damages and you end up having to fork thousands of dollars to replace with another frs/brz then yea I would pull the injury claim. hahaha. The most you would probably get depending on the adjuster and atty would be a few thousand.

I'm sorry, but I hate what you just suggested. If damage was done, absolutely it should be covered, but the intent of your message (ie the "opportunity") is one of the problems in America IMO. Not to mention the very thing you are suggesting increases everyone's rates, including your own when done on a large scale as it is in our country.

You don't honestly believe chasers are that honest do you?

A case in point:

A co worker BUMPED a lady at a redlight. The damage was limited to one broken clip on the co-worker's bumper cover and zero visual and structural damage to the lady's car. Once the cops arrived, the lady claimed it was a very hard hit which caused her to slam into the vehicle in front of her, which had significant damage. Strangly the driver in front of her must not have cared since they left seconds after the accident. Go figure. Also, the damage on the front of the lady's car appears to have been there for awhile (dirty, rust in areas, etc, stuff that is obvious that it wasn't done at the accident that day). Well the cop wrote it up anyways and now this lady is suing for all sorts of medical problems, even though none were reported to the Police. She is asking for upper 5 figures for damages and medical issues. She even claims to have all sorts of MRIs, CT scans, etc. Here's the kicker, she's *PREGNANT!* Go find a Doctor that will do CT scans on a lower back of a women who is pregnant.

The best part is that she's allowed to claim she has had all these tests but my co workers lawyer can't mention the pregnancy part and the obvious risks associated because he can't bring up her medical conditions.

So the insurance company already paid this loser money because it was cheaper to do so instead of going to court and my co worker is now having to goto court to fight this BS.

Sorry, I know it was a typo but this was funny...

To the OP of the thread, glad to hear everyone was ok and hope you can get through this all quickly. Accidents suck and can be stressful to deal with. Hopefully it didn't/doesn't screw with your holidays too much!

I'd imagine since your car is totalled they'll send it to a scrap yard and it will be parted? If that's the case I'd stay aware of where it ends up because if you're going to get another FR-S or a BRZ then I'd be snatching up everything extra I could such as wheels and etc if you're interested in maintaining the original look of the car.

Good luck!

My co-worker was rear ended, thus he hit the car in front of him. 100% not hit fault but his insurance had to pay for the car he got pushed into, every state has different rules. In NJ if you rear end a car no matter if it is your fault you must pay.
