Asked a lawyer this- I was told that the noise would potentially impair the value of the vehicle enough to cause it to be lemon law eligible. This is in CO. Your state may vary as we have a clause for items that affect only value, not drivability.

Seems like a lot of trouble and loss to go through on everyones part considering its just a semi annoying noise.

my paperwork is really starting to stack up. car has been to the dealer so many times now. they said they know how to put in my new ECU so hopefully that goes well. i haven't heard back on the chirp noise coming back and i have heard nothing about the condensation in my taillight.

I could see getting super mad if you are getting CEL's and stalling, just not over the chirp IMHO.

In California and Arizona it is very easy to claim a lemon you only have to prove they are wasting your time and that you have been inconvenienced by all the trips to the dealer. I have been 4 times for the same issue and I have to go back again on the 8th for them to try again... in Arizona and California it says in the law exceptions can be made which so really it all depends on the lawyer

dropped the car off friday morning at the end of the day they tell me it has to stay till saturday. now he calls me at the end of the day on sat saying they could not hear the chirp and that its running normal... the same thing they tried the first time, sounds like i am going to have to get a corporate guy back into the dealer to hear this shit again.
they are also trying to give me the run around about the condensation in the tail light as well. Well i have pics of it. So i asked about my headlights and if they got the new ECU in they guy didnt even know. so now my car is in the shop over the weekend at the least.


i hear its hard to get a car lemon lawed in California unless it has a saftey or performance issue. sounds like i might have to look into it tho.

I'm really losing faith in Toyota I had transmission issue with my charger and dodge could not duplicate it but gave me a new Trans for free even though the warranty was up Toyota really needs to stand behind this car or it will follow the path of all the rest of their sports cars and be out of production before it has a chance to show it can be the next 50 year production car and I think it has that potential

I'm going to schedule an appt. to take mine in later this week to have them look at it. i have to have this fixed, along with condensation in the taillights, the ecu and see if they can fix a high RPM idle.

What will this noise sound like in 4-5 years when the car is out of warranty? Will it effect reliability? Nobody knows, and I believe that's why it would be lemon law eligible. This is a good point. This defect needs to be either really fixed via TSB soon, or placed into recall status so all cars are protected for their lifetime. Making us travel to dealers for multiple visits is a waste for everyone involved and will cost more than using a new part.
