the frame is 'within spec' but that don't mean its straight

I would've tried to get that written off/totalled/whatever and get a new car. It's only 4 days old so it should have nearly full value. and since you went through insurance, the accident is gonna show up on a carfax. if you keep the car forever that's one thing but GL trying to sell a car that was in more than a minor fenderbender

I tried to get it totaled but its only 8k in damage. Had to do upwards of 15k for the insurance company to total it. It'll be fine.....I hope.

And it also doesn't mean that the frame is damaged and driveability/useability of the vehicle has been compromised.

Carfax doesn't specify the amount of damage to the vehicle in the accident. To the buyer that looks at the carfax, they couldn't tell the difference betwen this and a minor fender bender. They see accident/damage reported, and then a small blurb about the area of impact.

OP, just make sure when you get it back from the body shop that it's exactly as you want it and everything looks and feels normal. One thing you may want to look into, and might be worth pursuing, is being compensated for diminished value of your vehicle since it does have a mark on its record now.

Find a lawyer.

It's something I researched a bit a few years ago when a dealership crashed my otherwise pristine GTI, but unfortunately you can't claim dimished value in SC . As far as I know, you'll have to get an appraisal and go through some steps, but you could end up with a couple of grand or so.

edit: I am NOT affiliated with this site in any way. Just trying to help out. But I looked it up on Google and this came up. Might be worth it. http://www.neiserlawgroup.com/autodiminishedvalue.html

Depends on whether or not the woman has insurance.

Also, this is why we buy insurance. If you have a good company, they will cut you a check (if the car is totalled) or pay for the repairs. Then the insurance company will go after the other driver or the other driver's insurance company, and you barely have to lift a finger.

Not insurance, no. I'm not talking about getting the car fixed, and I have no doubt that insurance will take care of that since that's their job. Most insurances neglect the fact that the car is now worth a few grand less because it was in an accident though, and the OP is entitled to compensation for that loss, since he is not at fault.

Ah, I see what you are saying. So it more depends on if they choose to total the car or not.

Exactly. If the car was totaled it'd be a wash because he'd end up with a new car. Since it's not (posted above,) he's due the difference in what it is worth now becuse of the negligence of the other driver.

You need to see Alabama, son.

The drivers here are absolute maniacs, especially in the Capital where I live. People cut you off constantly, they NEVER use turn signals, and there's 30 pickup trucks on every block with lift kits and straight pipes, with UA stickers all over them. The worst part is that the pickup drivers always think they own the road, and if anyone were to get into an accident with them, they'd most likely die.
