This is not a collision BTW. You hit an object on the road, not another car/truck/whatever with a driver. Bottom line.

Man, sorry for your troubles. It may not make you feel any better, but here's what's going on with your insurance company.
It's not an uninsured motorist claim because it was a hit and run. You need an identified driver before you can make an uninsured motorist claim. (And it's likely that your uninsured motorist coverage is for bodily injury, anyway). Hit and runs are collision claims. It's not a comprehensive claim because you collided with an object. In general, if your car is moving, it's a collision claim. (Hitting an animal is the only common exception I know of.) Usually comprehensvie claims don't affect your rates. (A good guide.) If you file a claim under your collision coverage, your insurance company won't pay a dime until your deductible is met. Even if the claim is more than $1,000, make sure the amount is worth the risk to your rates. You don't want to file a $500 claim and get $1,500 surcharge in return. (Most states have a threshold of some kind.) The insurance company wrote the rules and calculated your rate based on those rules; you can get coverage that pays at very low deductibles and in almost all circumstances, but it would cost more than you want to pay. That doesn't mean you won't save money shopping around. But the rules for claims are pretty much the same at every company. Frustrating, I know. I'm no fan of the system either. |

I had a similar experiance and mine was covered under comp. Collision is always an "at fault" claim. Comprehensive covers anything else that is out of you control. A flying tire is comprehensive and object in the road that is not moving is collision.

If your car is parked legally and someone strikes it and leaves the scene without identifying themselves, that is a collision claim under your policy but it should not be an "at fault" loss. If it is you should consider changing insurance companies.

How much are you saving in premiums by having your deductible so high? $1000 is a bit steep IMO; mine is $500 because it didn't save me much having it at $1000.

The BBB is a scam, don't bother.
Tell your insurance company you want their decisions in writing, by mail. Don't ever simply accept what they tell you or lead you to believe will happen. Call up and argue your point. |

File a complaint with the department of insurance. I was t boned by a ford explorer a few years ago and his insurance company was saying I was 30% at fault because I didn't use preventive/defensive driving. All the evidence showed he was completely at fault, so I threatened to file a complaint with the department of insurance. Sure enough I get a call from them the next day saying that they went over the file again and would accept full responsibility.

Like a good neighbor...............just bend over and take it should be they're ads. Check with some other insurance companies for rates, then file a complaint if they still don't want to play ball, then dump them, write a letter to the editor of your local newspaper and then write the insurance commission.
