Not sure. In the states emissions enforcement on passenger vehicles is done on the state level even though the regulations are federal. EPA is federal so by hiring a bunch more agents they are likely enforcing industry. It's not like you are going to see a bunch of federal smogging stations pop up and start requiring you get tested. There is nothing in place policy wise I am aware of yet. EPA regulates a giant umbrella. Them hiring a bunch of agents is pretty meaningless to us.

Too bad the EPA suing tuners means we won't get the emissions stuff at the tune level so it doesn't matter.

You asked "how" it could be done not "if" it would be done.
Not playing a word game just "If" the feds decide they want to attack it at the general public level they could by putting enough boots on the ground. Obviously at this point they just don't care enough about the end users to focus on them. The suppliers however are an easy target at the federal level.

Have they gone after car tuners? I know in NJ they don't really care as long as it passes the emission test during inspection. The only crackdown I've seen is on diesel truck drivers who are removing cats so they can "roll coal" (0 issue with the state cracking down on this)

Just hiring bodies isn't a how though. Without probable cause a crime is being committed it is not legal for law enforcement here to search you. If there are no legal provisions for them to enforce laws then they just hired a bunch of janitors.

So they set up a bunch of federal inspections stations. If they decide to enforce the federal LAWS and the individual states won't do it then it is feasible. All depends on how much money they want to throw at it.
Not talking about a bunch of guys running around puling cars over or anything like that.

Of course once tuning software is released, the subject becomes why you won't be able to tune your car.

It looks like as long as they have documented emissions tests showing that the "mod" does not increase emissions then its within compliance. I'm not sure how PFI labeled their products and services but that MIGHT be the reason why they cracked down on them. And why trucks are getting hit harder.
There's a grey area here, a shop that sells a tune which does not enable the removal of a CAT and with a test showing emissions compliance should be fine? (at the federal level)

Trying to follow the laws is like walking through a maze. Where something may look like a loophole another section twists around and closes it. The law is an not a couple of lines of print but about 1,200 pages. I have to deal with the industrial end of it (it is not just cars and trucks) everyday and still struggle with the damn thing.
What it boils down to is that NO alteration of the stock system is permitted whether it changes the emission or not so technically there is no such thing as a legal aftermarket tune.
Trucks are hit harder because they are more obvious to the general public and let's the EPA say "See we are doing something". Cars will get their turn.
