Dude, you're in Helotes lol. No one checks emissions there. If you're that worried, go to Pipecreek or Bandera. Joking aside, I passed here in Austin with my ACE headers, so you will be fine.

As for the legality, by law, any tampering with emissions is illegal. It comes down to various factors for you to get caught.
