There are two sides to every story. The accident was disclosed, visual inspection and test drive completed and price discussed. A deposit was never requested. Upon hearing two other people were interested in seeing the car the same day the seller requested that the other people be turned away with an on the spot cash deposit. He had previously lost out on another FRS and did not want to lose this one. There was no paperwork. We depart and the other interested parties are declined. The buyer texts about picking up the car on Friday and ensuring UVIP is ready. Then the Buyer inquiries more about the accident. The VIN is provided followed by three photos of the list of parts from insurance. Buyer then offers a lower price stating this is what a body shop recommended. The low price is declined. Buyer then requests deposit back. This is declined due to non-refundable deposit. An agreement is made to inquire on the two other interesting parties and return deposit if one is interested; one purchased a BRZ and the second is too busy and declines. Buyer demands deposit back. He disagrees with the condition of the deposit and threatens legal action. He then states this is a scam as the car was posted in December and is not worth the price. After discussions, an EMT of $250 is sent to buyer to settle the disagreement on the deposit. The buyer accepts the $250. Buyer then sends threats for remaining $250. In which contact is cut and phone number of lawyer is provided.

Was any of this in writing? Was the non-refundable deposit clause fully understood? Was the agreement of $250 in writing?

If not you have no grounds to stand on in contract law. Also the fact there is no accident disclosure in your ads makes it look even more like you were trying to scam someone into overpaying for the car.

At the end of the day it's only $250 and it wasn't yours to begin with, not seeing why you have such a problem returning it.

I have sent the buyer another $250 EMT. To clear up what has been said, the vehicle has a clean title and was not in a major accident, it was a front end accident and no airbags were deployed. The other vehicle involved had scratches on the rear bumper. I had provided the buyer everything he requested regarding the accident including the VIN to conduct his own report. The papers show the vehicle was thoroughly inspected including the frame. The HID/LED headlights were replaced which were a significant part cost. The vehicle was listed in December however we decided to keep the car over the winter and sell in the spring market. Hence there were no bumps to this post. Lesson learnt, a deposit should be accompanied with a non-refundable contract stating what was discussed.

good news, seller called me this morning and agreed to give me the rest of my deposit back. It has now been transferred. Thank you to everyone for your help in this matter, I'm certain it was your responses that made him see the light, again thank you all

Optics is everything here everyone.

As soon as there is some slight lack of clarity, people go off the handle.

Lets assume LTuned & Imprezza did talk about the accident. It seems they must have gotten to know each other well enough in person and a level of trust was developed if a $500 deposit was exchanged

I'm going to say THIS is where the deal went sour. Imprezza didn't do his due diligence to ask see the repair bill before the deposit, even though the repair details were discussed and Ltuned did not show the repair bill. This is grey. Who is supposed to ask who for the clarity? BOTH parties were acting in good faith here. The accident was discussed. Its just that the evidence wasn't shared.

Now. Lets look at if good-faith is maintained. And evidence is WITH HELD or not?

Imprezza was so emotionally into this car he put the $500 deposit down on the spot without a contract. And off he went.

Next day, he's thinking hard about his purchase. Second guessing. Questioning.

Asks for evidence.

Imprezza. Did Ltuned send you repair bills? Was it truly a "mishmash" as you say? What makes it a mish mash if you were able to total amount of damage and the damage details itself?

Ltuned continued to act in good faith and SENT you the VIN and the repair bill EVIDENCE.

At this point, I'm sure Imperzza loses his mind because he can SEE the repair bill. $6K?! things replaced? Line items for repairs, paint blends, misc fastners, parts etc. all show up on the EVIDENCE presented to you.

"F this. I'm not buying this car" - is probably what Imprezza is thinking.

So why paint Ltuned in a bad light? Especially if he acted in good faith to split the deposit difference.

So I see blame on both sides here. Imprezza not doing due diligence and backing out. But Ltuned not being pushy like "hey look at this repair bill".

$250 returned to Imprezza seemed like a fair compromise for me. Especially because Ltuned always acted in good-faith. And Imprezza has actually painted LTuned in a bad light on the forum with lies.


But I guess all is good now. Except........ well. there were some lies spread on here. and ppl think LTuned is a terrible person. But that is the internet.......


Buyer be fully aware. Seller be fully honest. That is all that society can really ask.

It's too bad that it took this exposure for the seller to finally do the right thing.

If you're being honest to start with, and don't hold on to people's money without a valid reason, there would be no problem.

I hate people. lol
