I'm not in favor of suing someone in general, but when dealers throw their weight around, and you know they're doing it to other people who are not as knowledgeable as you are - they deserve to have their d1cks handed to them on a platter. Fuck them. Not for your own profit per se, but to help defend other people from getting screwed as well. Defamation http://www.nolo.com/legal-encycloped...ple-29718.html

Subaru raked me over the coals pretty hard on my transmission issues. I think they just assume that 99.9% of people are going to buckle when they throw their weight at you. I would ask to see the records proving your car was in this accident, and also, those records must reflect some warranty-voiding work performed specifically on the cruise control stalk. You can also get a Carfax on your VIN to document the accident / non-accident history. If they're going to make claims like that, make them prove it. If they falsify documents to "prove it" -- they're going way out of their way and putting themselves in a really bad spot. At that point, no question, you lawyer up, and you will get your car and then some paid for in a settlement. |

To be honest after the engine and the legal battle I am still in the middle of with that I have no idea what to expect with this and frankly with how long this one has taken and it is cut and dry I can't imagine trying to fight another.
I was just going to vent here yesterday until what happened today, after this I went ahead and left them feedback in a few places and will pass the information along to the Attorney for him to see if it should be dealt with inside the case we already have going. I don't expect it's ever going to result in much of a change but I guess we shall see. But in terms of them paying anything I have not really held my breath on that, can't see it changing. Frankly I just don't get how I could have modified the stalk or how they could even try and support that. My only thought (Which has gone through my mind a few times) is was I to rough on it, did I ever really abuse it and honestly even if I were to think about it overly protectively it's a Cruise Control Stalk behind the wheel that you use 2 fingers to operate... Even if I used my whole hand, in order to break it clean off I would have to be excessive and trying to do so. It just broke, it sucks but it wasn't because I did it intentionally or modified it. However I do need to make a Carfax thread it seems just so I can have one to show since apparently my car got in an accident... must have been when it was sitting in my garage holding down the garage floor for almost a year covered in dust.

Huge load of crap. Personally I'd be over at Desert with a recorder in my pocket and asking who they talked to at P-Toy and exactly what they said. Then I'd head over to P-Toy with the recorder and talk to that person and ask, pleasantly, why they are making up lies about me.
And then I'd post those conversations to YouTube. Bastards. Sent from my iPhone using Tapatalk
