I had an interesting encounter with a state trooper once. I had left my friend's house after eating and had one beer. I waited about 2 hours to leave, but being Chinese my face was still flush and pretty red. I was completely sober but it's just what happens when I drink. On my way home I was pulled over by a state trooper on the freeway. He looked at my face and was obviously convinced that I was intoxicated. After making me do all the stupid balancing tests (holding one leg up and all that stuff), he made me do a breathalyzer test not once, but twice. It kept pulling up ~.002 and he finally gave up. All he said was:

"Well you passed with flying colors. I just don't understand why you're so red. My advice would be to just not drive at all if you plan on drinking."

I think to save face he also said he was going to let me off with a warning for not having a front plate. He looked legitimately confused after the breathalyzer.

I second that. We live in a free country and are protected by the Constitution. Most cops have nothing better to do and there's a term for them stopping people at random for questioning, it's call "profiling". By standing your ground, refuse to be talk down to and profiled doesn't make you a d***. In a situation like that, all I would say is "I plea the 5th", "am I being detained?","am I free to go?" Politely of course

People who are scared of cops and voluntarily to have their rights trampled on are the reason why most cops are power hungry crooks.

For all of those who believe in the whole "innocent until proven guilty" thing, just get charged with a crime and let me know how it works out for you? The reality is, we live in a society that says one thing when the reality is "you're guilty until proven innocent".

You're innocent until proven guilty in a court of law, the cops just assume everyone is guilty and let the courts find out for sure. That's the difference between the judicial and executive arms of the government. What the general public thinks is a whole different matter though.

You totally missed the point of what I said. If you get charged, even if you are innocent, you better be prepared for the consequences. Attorney fees, stress, possible loss of job/friends/family/ etc. It doesn't matter what the theory or concept is, you will have to prove your innocence to the court otherwise you will end up with a conviction, legal fees/fines and possible jail time depending on the conviction. My experience, most "innocent" people take a plea because either they don't want to take the gamble with a more serious conviction or they don't have the money to fight the charge.

Edit-to further clarify, law enforcement makes the arrest. The DA decides on whether to charge or not. If you get charged, then you will have to prove your "innocence" unless you take a plea or the DA decides to drop the charges.

Well, I would say It's too easy to "prove" guilt, or rather people are too easily convinced. But you are right that just being arrested/charged with a crime can have serious consequences.

I've known a few people in my life that have had their lives totally changed because of a charge that wasn't warranted. For example, just imagine if the OP had been arrested by the officer. He was walking through a nice neighborhood late at night, "fit the description" of a suspect who had been involved in an assualt, had alcohol in his system and is a minority. What do you think the DA would have done? My money is they would have charged him. At that point, he'd have three options. Plead innocent and go to court, take a plea or plead guilty (techincally he could also plead "nolo contendre" but usually that's for people who have worked out a plea bargain). No matter what option he chose above. all would involve him having to attain a criminal defense lawyer (read lots of money if you want a good one) and his life would be changed forever. At the end of the day, he has to prove his "innocence" or get a conviction for something he didn't do.

Your comments just made my point.

Complying with police doesn't mean you're a doormat, nor does it mean you have to be a **** like I've stated already. It's fine to stay within your rights. What I was referring to is people who get all offended for the fact that an officer would even stop them. Then they start shouting and throwing a temper tantrum because they're "innocent". Unless you're legitimately being harassed, there's no need for it. Like you said anything can and will be used against you so go ahead and be a jackass; or you can just comply for a moment and be on with your life.
