Did you ever stop to think that perhaps he doesn't want to wait to find another car?

Further, someone who is ignorant of legal remedies should not be so quick to spout unfounded rhetoric. The car was designated for him, it was misappropriated for personal and unauthorized use, and thus subjected to unnecessary wear and tear...how is asking for compensation (which can be something as simple as some free accessories, getting something for nothing?

I eagerly await your logical and thoughtful response.

I'd call Scion corp immediately and give them an earful.. I would demand additional extended warranty from either Scion or the dealership. If the guy commented that it was real fast, he clearly did things that are not recommended in the owner's manual.. Most likley no harm was done, but you never know...

Until the car has been signed over to the new owner and paid in full. It is the dealerships car and they can do as they please. Hell they can swing it 75 feet in the air with a crane above a freeway to show it off if they wanted to do so.

Next.... Mr legal beagle, You should also understand that unless you have proof that the car was beat up, red lined, wrecked or what ever. Its 100% hearsay. Maybe a "sales" guy was talking out his #$%. It happens more then not.

So storming in asking for the world is going to get you no place and might even burn a bridge. I'm not say what the guy said was the right thing. I'm just stating you have no grounds to do anything.

HAHAHAHAAHAH, hearsay, that's not even relevant in this matter (this matter isn't concerning admissible testimony.

We are missing several key facts here, but it is clear that this is not
professional conduct on the part of the dealership.

The first 86 contest winner does have grounds to do something. 22 miles is unnecessary and unreasonable given the nature of the first 86 program. In light of the first 86 designations granted willfully by Scion, the individual in question does have an interest in the property, though obviously not the same type of interest as someone who has signed a purchase contract and taken delivery. Further, their are alternative theories which would allow the aggrieved individual to pursue compensation should he decide not to take delivery as a result of the mileage/wear concerns, and is forced to expend additional efforts or
or money as a result of the aforementioned issue.

first86 cars are considered "custom orders", unless the first86 winners forfeit the cars, the cars have to be reserved for them. my dealer explicitly stated that if i were to refuse the car they had to send it back to corporate. although i don't think they have to be that extreme, i do believe they can't just sell to someone else without letting the corporate know.

your perception about what's normal regarding the miles and my original perception are different. I now believe that my dealer is accountable and feel comfortable with their "10 mile" procedure, my car was picked up at 12 so I'm on your side on that matter. However, to not care if some guy from the dealer talking about your car like he just f a wh then you probably don't have a car in pre-order or just don't care about this car that much. I let strangers sit in my car if I think they are enthusiasts like I am, but I'll nail someone to the ground if they think joyride in my car is funny.

And the dealer doesn't care if you buy the car or not. He will just resell it and make more money on the next guy. I do not know the details on the 1st 86 club or what ever. But I am sure Scion fixed the price as part of the deal. So if you do not buy it. They would be just as happy. They would just turn around mark it up and resell it for more.

I do find it funny that no one ever listens to a car sales man. They are all lying dirt bags and what ever.. Then a guy makes a comment and now lets all get pitch forks and torch the guy.

There was demo cars out and about for rides and such. This guy could have been talking about one of those cars and not a brand new car.

Anyways.... Toyota runs all the cars before the dealer sees them anyways. They are not going to hurt anything.

I think we're all comfortable with the fact that pre-delivery inspection calls for a road test.

The concern is over a dealership employee taking the vehicle on a "joyride" that went went beyond the scope of such a test. If this happened, it needs to be addressed. The only person driving the car aggressively should be the happy new owner.

It has a lot to do with it. The guy did not state which car he drove hard. He just stated that they run really good.

Next I am sure that there is something in the paperwork that states they can swap the car out for another car. And until you sign on that line, and payment has cleared. Its not your car. You might be in the club. But signing up for the club doesn't make you the automatic owner of a car. Otherwise I'd just show up after getting into the club and demand my car without payment. Right?

If it happened. But at this point we only have some guy making a comment. Which means nothing. Was it the correct thing for him to say? No... But he could have been talking about a bunch of different cars and not this one guys car.

Dealers are not packed with a bunch of cowboys ready to smash your car down the freeway.

but you don't understand, there is no demo car, at this point, there is none that i know of and there shouldn't be any. unless it's some towns where no one cares about car, every dealer has a long wait list and not enough car to sell, why the hell do they have cars for pp to test drive?

I work in the high end motorcycle world. Ducati, MV and Harley few other brands. I deal with this stuff all the time. I deal with Ducati and MV owners that do not even want us to take their bikes out of the crate. But I then take the time to explain to them why we have to and what we do.

I also have owned many pre ordered cars, trucks and motorcycles. But I also understand things better. I also feel out the dealership before buying.
Walk into a place and shop the service dept. Or parts dept. See how things are and how they treat you. Ask some dumb questions and see how it goes...
Is the shop clean? is the floor clean?

Do that before you buy...
