A DV claim is the loss in value of your car which you can claim. A car w/o an accident is worth more than a car w/ an accident. Basically, you look at what a car would cost retail value before accident, compared to value after accident with repairs. That's a general estimate of the diminished value you could get. It's a bit more complicated than that, but that's the gist of it.
Or you could just wait for an ambulance to drive by and run after it....

Dude, this post really heated me up. I'm sorry man, I hope that fcker gets whats coming to him.

And I hope it's totalled, I can't believe you had 400 bucks left on the car. I hope they give you another new BRZ. I hope everything goes well for you.

In most instances you can't file a diminished value claim against your own insurance policy. They normally have an exclusion written in the policy. Diminished value claims are normally claimed against the at fault party's insurance company.

If they decide its totaled then they will issue a check for the current ACV (actual cash value) of the car as determined by various methods that they use. They will explain how they arrived at the figure. You can try to fight them if you don't agree on the value, but normally it's a tough fight to try to get more than what they have appraised it for. They put the burden of proof on the claimant to prove why it's worth more after they make their initial offer.

If they say it's repairable, then they'll fix it.

Just went through a couple of accidents my 18 yr old had. Totaled the wife Jetta. Insurance company used a third party to value the car. The report was lengthily and very detailed. I felt comfortable they were being fair. I wanted fair, not getting screwed or screwing them.

Next aaccident he hit my BRZ parked in my driveway with my F-250... guess which vehicle won that contest? Cut out and replaced driver rear 1/4 and new door as they do not sell skins. Insurance paid out just under 5K. I had just "cosmetic" damage, no mechanical. They may just total it, IMHO, it will be close.

By the way, the young' got a speeding ticket in-between that, They canceled my insurance last week, or refused to reinstate that policy and want a new one... monthly premium with him on the policy, $997/month. He is now "excluded" and I'm with another company at $277/month for the new Accord (Jetta replacement) and my F-250. BRZ is a "work" car on my commercial policy.

That depends on the state. It ranges from 50% (Iowa) to 100% (Texas), or the insurance company can use the "Total Loss Formula" (TLF), which totals the car if this is true:

If OP's profile is correct, it looks like he's in California, which is a TLF state. The insurance company would normally use the formula above to determine whether it's totaled. In that case, there's a good chance they'll total it, because the salvage values on these cars are pretty high.

Salvage value for my car was 9k... Not that high really. If he gets totaled, no diminished value. Might be better off getting diminished value + repaired car, then sell car...

the inspector said it looks fixable on the surface, but had to get the car towed to a auto shop to get it taken apart to see what really was damaged.......
but since the rear tire is all jammed inside, not to mention the air bag on the passenger side deployed, im guessing the chasis/suspension or axles is badly damaged ?
but i still need to wait for them to tear is down to see whasup.....

any hope that is actually fixable? but will the car still ride the same if its all fixed up?

I read one thread a while ago where a similar level of damage was done. The owner wasn't getting "it's totaled" from the insurance company. Then he started pushing for diminished value, then they decided to total it.

Might be a lever to try.

i think the axles is gone lots of body works too, suspension maybe.
result wont b until tmr, smd waiting is a bitch
what if its totalled? i have full coverage on my insurnace? what if they decided it aint totalled, how should i fight for it to be totalled.
