There is something about holding the fob to the start button if the battery is dead to start the car there is for sure something passive its not NFC but I can check if its RFID tomorrow at work.

This is more on the illegal side.
Can it be done - absolutely as thieves in Europe have been hacking RFID keyfobs for ages before it came to the US. They use notebooks to scan and hack the RFID system ( they just connect a 10 dollar usb dongle ). You can see youtube videos of them doing it to BMW's so yes a Subaru system would be no more difficult. The problem is the software is not exactly on the legal side to use so a mobile version is possible but it is all over torrent sites. The hacking is much more rampant now with the internet. Most likely or maybe they have a zigbee network installed.
Would be cool if they did though.
