To put the rear seating space in perspective (since there hasnt really been a whole heck of a lot of clear pictures with people in the back, and sizes of the people), It looks like the diameter of the 17" rims with tires represent roughly an equal size to the back seat space with the front seats all the way back.

So whatever space you're looking for/needing/wanting, go look at some 17" wheels with 215/45/17 tires and any legroom would have to be added to that diameter.

Agreed. The seats can't even recline in this configuration and are pushed forward several inches. Everyone's blinded by the fact that it's a RACE CAR NOW!

The seats are pretty far forward here, but you could store the tires vertically instead, and that would free up about 8 inches. Front seats can move all the way back, problem solved. You lose 200mm of the rear window right behind the seat, but the middle of the window should be visible. No worse than putting a large box in some SUV.

The rear lip spoiler doesn't stick up that far, so it wouldn't block the 3rd brake light even if it was placed lower. My guess would be that there are regulations about the third brake light being a certain distance higher than other lights.

The spoiler clearence theory is much more believable than your idea. Either way at least its just a quick minor fix for the nitpicky, the clock in the cabin is also dumb looking design.
