In the end it would be up to the judge, but it looks like the venue could be kept in California based on the location of contract signing (assuming that was in California as well.) or on the basis of a consumer goods purchase.

Bit of digging round on the internet seems to suggest it was due to frequent engine issues (basically going pop) - the DI issue seems to be the main culprit

I just put a feeler out to buysubarupartsnow.com to see if a customer wanted to order that part # would they process the order and if it was the full long block.

I've dealt with them quite a bit in the past. I'll let you know if they're able to order it.

We are going on over a year with this DI issue without any official acknowledgement from Toyota, Why isn't this news at a site like Japolink or TTAC ?

Are entusiasts down playing this issue to keep resale from tanking before we get out from under these things? I guess I am sitting on a car I can't drive, a dealer who won't fix it and am having a hard time swallowing the koolaide.

Fill us in before TSHTF..

Let's be honest, very few people have been affected by this and even if news of the handful of rent a race cars being pulled from the fleet at Nurberbring hit the enthusiast sites, it would have little to no impact on overall sales of these cars. If the issue was more widespread and there were reports of thousands of engines being seized, then I can see it being a big deal and Toyota/Subaru being forced to take action once articles from Consumer Reports started hitting the newswires of major news sites (AP, CNN, Foxnews, USA Today, etc). Even then it may not impact sales that much based on brand loyalty and excitement over the cars. Look at the accelerator issue with Toyota. People still buy a Camry and don't think twice about it even though the Toyota is still publicly dealing with the accelerator issues and are still being sued.

I also don't understand why you cannot drive your car. I assume you have taken it to Toyota and they say there is nothing wrong and you have that in writing? So the next logical step is to drive the car until the engine seizes and then start going down the lemon law path and get a car you don't worry about every hour of the day.

That worked out so well for us...

The reality is that I've had more than just a few people PM me saying that they've had the issue, but are unwilling to publicly post about it for fear that they will have their warranty claims denied; many already have had their cars turned away.

Lemon law is over where I live as I've owned it for a year. I'm not into driving an engine till it seizes, warranty doesn't mean you always get a factory assembled replacement.

So what happens if Toyota never issues a fix? I understand your frustration on this, but at some point you should just move on. Resale on these cars is very good.

I'm not a lawyer, but this isn't entirely true. Even if your state has no specific lemon law (or you have reached the time limit...haven't checked your state for specifics), the Magnuson-Moss act still applies. Subaru / Toyota, by claiming the warranty is 'full', have legally obligated themselves to pay you back for the product after a reasonable number of failed repair attempts. Lemon Laws are typically more specific, but not the only way to get things done.

Where and when were we racing our car? This car was never raced. Please, find us a single shred of evidence to support that claim. There are no modifications to the body or engine and no mandatory safety equipment installed.

Track Warrior's caged (roll bar?) car on comp tires was TOWED to his Scion dealership, and was still covered under warranty.

Have you ever Googled "Counter Space Garage + BRZ", or "CSG Mike + BRZ"?

What is your lawyer advocating at this point?
