I don't see how they can deny the warranty if they have no way to prove it, especially since you are being so open. I am sure if they wanted they could tell if something had been modified and also do forensics on the ECU.

On the flip side I can see where other performance shops would mod the hell out of the car, beat it to death, and then try and get warranty work performed. Clearly, you guys are not that kinda shop.

Hopefully you can get this resolved one way or the other. As you stated in your original post both Subaru and Toyota have marketed this car as a sports car to take to the track. Which you did. There should be no harm in that, not to mention you are not the only person that has observed the DI issues, so this is not an isolated incident.

Good luck.

This seems like the ideal case for small claims court...

The reward limit is less than the cost to replace the engine.

Is it? These are the limits I found from California: http://www.nolo.com/legal-encycloped...uch-30031.html

Quote:
$10,000, except that a plaintiff may not file a claim over $2,500 more than twice a year. Limit for local public entity or for businesses is $5,000. $6,500 is the limit in suits by an individual against a guarantor that charges for its guarantor or surety services.

Basically, assembling a short block, and then dropping it in.

Parts cost was something like 8100? New from Subaru of course.

P/N for the longblock is over $7000. Add labor, etc.

Weird. Buysubarupartsnow.com has the entire assembled engine assembly (Part #: 10100BV290) for $5515.21 ($7353.61), unless that's missing some parts that i'm not aware of.

So take them to small claims court for the cost of the long lock if nothing else.

Is the car owned by an individual or the business? If an individual it would be better as the limits for small claims would be higher.

Hmm according to ca.gov the limit is 7500. Either way, not enough. Also if the car is owned by CSG as a business then the limit is 5k.

Finally, if the venue is in the defendant's state, then its even lower at Jersey's 3k limit. SOA is headquartered in NJ. Usually the venue is in the defendant's state but I'm not sure if this is an exceptional situation.

As always, YMMV. IANAL. Yaddah yaddah yaddah.

In the past you were unable to order EJ2xx longblocks according to a local shop I frequent. The P/N existed, but no one would order it for you.
