Idk how it varies by state but basically in Florida, if you have to take the car in for the same problem repeatedly you can get a brand new car if you play your cards right.

Not saying you WANT a new car, but if you threaten them it raises the stakes for them to take care of it.

Also I just heard crickets for the first time yesterday at around 500 miles in. Will be waging war on the dealership soon. how do I know if the fuel pump they replace mine with is the right one? Any way to know for sure?

from what i hear you want the part # with the green dot next to it. But there is no guarantee that will fix it. I have had mine replaced with revised and the revised with the green dot and still have crickets. =(

Either i pay 25 cents more for each liter of gas. Or live with the cricket... fml.

You may be right honestly, I haven't had time to look into it very much. From what I understand in FL the law says:

"the Lemon Law covers defects or conditions that substantially impair the use, value or safety of a new or demonstrator vehicle (these are called "nonconformities")."

You could probably argue that this impairs the value of the vehicle but you'd probably have trouble escalating it to the point of vehicle replacement. It aids us to some degree that a technical service bulletin has been issued on the subject. You could argue that it's a known issue to the manufacturer and despite having the manufacturer perform the repair multiple times, the problem persists.

I was REALLY focusing on addressing the guy who posted that the dealer was refusing to perform further warranty work because that's unacceptable.

Also I more mean that you might be bale to use this to further substantiate other claims you were making towards lemon law.


Edit to add some detail for anyone in FL:

Rule 1:
If the vehicle has been back to the service agent for repair of the same recurring problem at least three times, the consumer must give written notification by certified, registered or express mail, to the manufacturer (not the dealer) to afford a final opportunity to repair the vehicle.

Rule 2:
If the vehicle is in and out of the authorized repair shop for repair of one or more different problems for 15 or more cumulative days, the consumer must give written notification of this fact to the manufacturer (not the dealer), by certified, registered or express mail.

Lemon Laws typically apply when the vehicle has been taken in for the same repair multiple times or has been in for repair (unable to be used) for a certain number of days.

Lemon Laws typically do not have provisions for severity of issues. He wouldn't be the first to lemon this car based on noises and leaks. Some people deal with it, others expect more from a >$25k purchase.

If I had a car that was out of commission for a month within the first year of ownership I would seriously consider getting rid of it no matter the issue, thank god for consumer protection laws. :happy0180:

33 days on the Green dot pump, over 1,700 miles, 93 Octane E10 (Sam's Club), Temperature in the high 90's, still no chirp....

The manufacturers have released a TSB describe it as an abnormal problem. They outline specific procedures to repair it which don't work.

This is the definition of a recurring problem. Sure, it's not impairing the function, but it IS impairing the value.

It's an acknowledged problem. If the company had just declared it a normal operating condition and never issued a TSB, I'd agree with you.

Edit: If you read the requirements of FL Lemon Law which I posted, it never says that the car has to be out of commission. Ever.

Most gas here is over $4 a gallon, Ethanol or no Ethanol.

I drive about 15min typically for gas but its worth it for the MPG and no chirp.
