how would a smog shop even tell if the tune is the CARB legal tune or an aftermarket tune if you keep the stock header/front pipe?

No, unless you choose to use fruit loop coloured fittings and bling lines. Otherwise it'd be discrete and literally only some twin owners will know.

Using E85 is technically legal IF your car is originally equipped for E85 from the factory. Getting flex fuel for our cars changes the tuning and therefore is considered modified.

Newer STAR smog shops use a combo of OBD2 check and a visual inspection. I believe the modified tune will pop-up during the OBD2 check.

I suppose an aftermarket tune might not pass smog if it failed emissions and/or the ecu could be checked that it had a dual map or wasnt closed or something. I dont know I'm just speculating.

Better for emissions but worse on gas mileage, right? They dont like things getting worse drastically. Just my guess. So is that a no on e85 being hooked up?

Not necessarily, you can always empty the tank and fill up with regular 91oct then flash back to CARB tune and be all set for inspection.

Oddly enough, I've looked into this myself (for work). Although E85 is proven to be better for certain emissions standards (mostly CO2), it is rated worse for others (NOX). Just so happens CA uses a combination of both, hence the current laws.

Actually, they have no way of seeing if the car's ECU has been remapped or modified. The OBD2 check is just for readiness monitors.

It's very easy to install discretely (We like the DT with race lines). The sensors used in the FF kits are all standard sensors used in many production Flex Fuel vehicles, so it doesn't exactly look out of place.

I believe a technical interpretation of it is that it is illegal to have it installed on a vehicle that is on public roads, whether it is being used or not.
