Crashed my Monogram... Totalled??

I'm soo bummed out!! On Sunday 1/22/2017 at 10pm, I was driving home from dinner. It was pouring here in SoCal. A pickup truck decided to run a red light. Mind you my light had already been green for awhile. I had to swerve or get t-boned. I opted to swerve. I'm running 265/35/18 Hankook RS3's with 50% tw left and I drive with all the driver aids off... so traction was already not great. I managed to avoid the truck at the cost of running up the curb. I looked to see if he would stop but of course he didn't. Luckily for me the person behind me helped me get the car off the curb. I have a 2014 WhiteOut Monogram FRS. From a visual standpoint there looks to be minor damage. Underneath is a different story.

Damage :
-CF HT Auto style lip
-ChargeSpeed Bottom Line CF side skirt
-Bent rim
-Front bumper
-Grill
-Passenger fender
-Misc suspension parts
-Radiator support
-Radiator
-Frame rial

Also, if you don't have one, buy a dash cam. It'll make it easier to prove your story to your insurance people.

call insurance asap, then they will send someone to check your car or they will give u their address to the shop. Then, wait 1 or 2 weeks to estimate the damage, and they will mail u the check.

Step 1) call insurance
Step 2) hope the premium increase isn't brutal
Step 3) leave the driving aids on when not on a racetrack

I wouldn't tell your ins co. your driver's aids were purposely turned off.

Especially in the rain.

Don't think it will matter much as there is no requirement to use them (unless there is a regional thing). Bigger issue is that unless there are witness statements and police reports indicating there was another vehicle involved they will just call it a single vehicle crash. Single vehicle incidents can have a huge impact on insurance rates.

This. Even if there is no police involved that saw it alot of times if you at least have a 3rd party to vouch for you most insurances will at least use lube when sticking it in.

Sucks, but in situations like this it would have been better had the guy hit you... Now all the damage is on you.

I should have said witness statements OR police reports. Don't necessary have to have both but one or the other would help. Totally impossible to prove cause without them in this case.

Does the same rules apply as the wild life situation? Meaning if you swerve to avoid them and you wreck your at fault for failing to control your vehicle? That would be my only concern with or without police/witness reports.

I can not speak for regional differences but here yes it does! If there is no evidence of an animal the police just rule it as reckless driving (or can they don't always). A buddy barely clipped a deer and went in the ditch. The cop was going to charge him until they found some hair and shit (literal shit) spread down the side of the car.
This dude (below) that crashed right in front of me and claimed to swerve to miss a deer was charged with reckless since there was no evidence of a deer anyplace.
So around here you are better off to hit them then to try and avoid them when it comes to insurance. You have to make sure you state it was moving and hit you though since then it becomes comprehensive and not collision. If you say it was standing there and you hit it then it is collision and will cost you a pile more.

I know that in the case of animals this is true I'm wondering in cases such as this with another vehicle if they can pull that kind of stuff on you in the absence of a police report or bystandard.

Sure they can. If you can't prove another vehicle was involved then as far as they know you just crashed. Be nice if they could just take your word for it but they have been lied to so many times they have to go based on the evidence at hand. No other vehicle presented as evidence then it is a single car crash. Same as a passenger in your car would not count as a witness (for insurance purposes) since they could be lying for you.
