Anyone cancelled order and did not get refund for deposit?

I'm wondering if anyone who has cancelled their order for the 86 was refused a refund on their deposit? I've requested to cancel my order and the dealer has not confirmed whether i will get back my $1,000 deposit. I understand that it's a contract etc etc, but they would easily replace my order with another buyer seeing that there's still a minimum 6 month waiting period on any new orders.

What can I do if the dealer comes back and says to me "sorry no refund"???

I bought my 86 at pennant hills (nsw australia) and the dealer warned me that once I put my deposit down ($1000) I won't get a refund if I back out. It's like a semi commitment I suppose.
Anyway sorry to say, I got told you get no refunds on deposits so if you get one, lucky you!!!

If the spec, price or delivery date has changed from when you ordered, they have to allow a refund.

I got a 1K refund from Grand Motors, Gold Coast without any issues whatsoever. Hope you get yours back.

Given the ease of selling a showroom 86 at the moment, I cant see why they wouldnt oblige however you have no legal right to your deposit back unless the car differs from the order.

Just a tip for the future:

I have been stung in the past so when I ordered I asked the dealer to put "sale subject to change in customers circumstances" or something along those lines which basically covers everything including change of mind.

Now im not sure that every dealer would be ok with this but sales people want to make a sale and sometimes they'll do anything to get it across the line. It certainly made me feel a lot more comfortable about the process.

Its absolutely worth giving this a shot on your next purchase. The worse they can do is refuse so its worth asking the question.

I had to back out of my initial order last year to switch to another dealership that had a GTS available on the launch date. I got my $1000 deposit back in full.

With that said, I had organised this all over the phone so there was no contract that was officially signed by me that they could use against me.

Just an update on my situation. Got a response from the dealer saying that they will not cancel my order as the car is arriving this month.

Quote from dealer:
"I have just spoken to XXXXXXX regards cancellation, Due to the fact the vehicle is arriving this Month and the vehicle being registered as sold to you with Toyota we can not cancel the contract. You can cancel the contract if you wish but be aware there is a 15% cancellation fee if you wish to go that way. Let me know what you want to do, The 86 will be here at the end of this month".

Im not sure whether the car is indeed arriving by this month, or whether its just a BS tactic to delay things until the vehicle actually arrives.

My first thought was that if the car is indeed arriving by this month, surely it would already been produced and I should be able to obtain a VIN number and/or stock number? Is this correct? And can the dealer refuse to provide me with a VIN number at this stage given what he has already said?

To be honest I would rather keep order and then sell it after delivery in order to save my deposit. But what I wouldn't appreciate is being told that the car is already arriving and then they might call up at the end of the month to say it hasn't been produced yet, or hasn't left Japan yet, or worse still....no idea when it will arrive.

Any advice would be appreciated.

Another update. So I called up Toyota WA to enquire, and the nice lady confrimed that my car has been scheduled for July production (batch number 6306581) and should only arrive mid August at earliest.

In other words, dealer told me lies. I need to make financial decisons before end of this month on whether I should proceed with the order or just sacrifice my deposit.

Anyway, end of rant for now.

Does your orginal purchase sheet have an expected date on it? If the actual date is more then 30 days after the expect date, you should be able t get a refund.

Well yeah i didnt actually realise till after signing the contract (and getting home) that it stipulated delivery in Sept 2013. So its kinda difficult to wriggle myself out of the contract especially with this dealer being hellbent on not letting me out. So I guess I'll just keep the order then...and decide what to do after delivery.

Anyway, if I were to find someone willing to take over my order, do you guys think dealerships would generally allow that? Coz essentially the person who is taking over my order is 'jumping the queue'. I ask this because I've noticed a few ads on gumtree where people are offering their place in the queue?

You have to be careful when putting deposits down on a car. I know my dealers contract stated, Any changes in price (price rise) Says that the Buyer will incur those costs. If i were to cancel, I'd lose my deposit AND pay 10% of the cars value for it. (This is in Victoria)

But i always get added to the contract "Subject to Finance" Meaning if i do not have the funds to get my car, and I cancel, I get my money back, and no need to pay more.
