I would say that they can't change the original sales contract unless you agree that to the charge by resigning the contract.

From another perspective, its the same as if you wanted to renegotiate the contract for a lower price after you have signed. You simply cannot.

Both parties are obligated to deliver on their obligations.

I'm still waiting too - After 90 days from signing the contract you can legally get your deposit back apparently if you wish to exit the contract. This is something I did not know.

i am worry about since i don't agree to resign the contract, they just simply dont give me the car, instead give to someone offer higher price.

You can ask the same question to OMVIC (http://www.omvic.on.ca/) to confirm. I think you can also report the dealership if this becomes a big concern.

Also talk to Subaru Canada and ask them about the status of your order. They might have more insight.

Its bad business practice to make you wait and keep selling the car out from underneath you.

Good luck with this - I know that waiting after putting down a deposit is definitely not fun.

Who was your sales person? I put down my deposit in late june and received the car in August. They shouldn't be allowed to do that as you signed the bill of sale when you put down you deposit. But then again, thats why they call them stealerships for a reason.

my sales person was Nic. according what he said to me, this idea came from his boss Carmen. i don't really trust Nic at this time, since this deal was 5 months ago and his boss owns two subaru dealerships. will he chase $600 after 5 months? anyway, i will go there tmr to see what's the trick there. BTW,did you get any discount from them?
