I can agree. This is different for me as well, but I feel this is whats best for this car. Atleast for the majority of end users.

For the users who's batteries go into the trunk, the filter can also be flipped if need be.

I've seen a few hood designs and that filter is not there by mistake

Looks good. Keep in mind that some of us are going to relocate the battery. Think there's room to swing the intake into that space? Leaves open the option of a strut bar. Can't see one going on the car with the intake in the current configuration.

With the Filter above the engine I can envision people installing a hood scoop and trying to do some kind of "ram air" contraption. Not that it would do much on a turbo motor.. but I'm sure someone will do it.

Now that I think of it a bit more. I'm pretty sure the filter is behind the centerline of the strut tower.

Your correct, it doesn't do much, but it does help a little. Negligible amounts.

How about its brother car the Imprezza WRX. Cat in the uppipe. The catalytic converters these days do not degrade for hundreds of thousands of miles. Theres no concern here from my perspective.
pretty sure toyota has never ran a cat before a turbo.... seems it would reduce overall flow to the turbo as well, at least to me.
