All cars with keyless entry and start have a specific range in which they detect the key fob. The best places for the fob are the center console area or your person. The car can have difficulty detecting the fob if it's in the door, or on the dash.

Taking it to subaru dealership tomorrow morning. It shouldn't be doing this at all.

Well...Long Story short... It turned out to be interference from my Fosgate 1200.1 amp mounted under the driver seat!

I mounted it in the trunk along with my zapco and no longer an issue!
