I am from Texas so our gun laws are very lax. I have automatic weaponry and suppressed guns. During the 4th we actually shot over 500 rounds in the back yard between shooting skeet and paper targets. Not quite a police state or a yank but it is a regularly accepted law often by other names in most states. Officer's opinion is a loosely termed law that makes police trained witnesses, having their word be higher weighted than that others.

I'm not a worried about fighting it. I know about the 2 in 5 years law. Although this is my first speeding ticket, I have fought others for other people and know enough about how things work.

I never give an attitude to the officer, but I do intend on fighting the ticket. Wondering if I should get a lawyer because I have free access to one.

It's also just rather inconvenient as now I have to go to court and what not. *sigh

In Canada, if you go to court, you have full right to request that the officer provide recorded evidence of using radar to clock you and provide proof that the device was calibrated prior to use.

can also meet with the prosecutor prior to your court date to negotiate terms, often people settle for this (since they were, after all, speeding) and get a reduction that is easier on the wallet and licence points.

If a cop here pulls someone over just cuz they THOUGHT you were going fast, their face will end up on the news the following day.

I wish we had interest groups in the USA as strong as the NRA to protect us from the joke that is the way we treat "civil infractions". You cant beat tickets without a lawyer. I have seen a judge drop a serious ticket without even hearing the case because the guy before me at court had some well known attorney. Then I get up and get reemed for going supposedly exactly 10 over the limit on an empty road.

I am a huge Ron Paul supporter but sadly the majority vote does not matter, only the Gallup Polls. I am more Republican than Democrat mainly because I like the idea of being left alone and have a small central government. I was at the UT rally for Ron Paul and I think there were over 15,000 people. Quite different than the town halls any of the other candidates got. The media had a different agenda and decided to go to the Romney rally with it's 400 people that happened the same day.

That's neither here nor there in this matter. I think your best bet is to just make a settlement and get the minimum or take deferred. Then again we don't have a points system here.

If you have access to a free lawyer then use that access. If you are a 19 year old coming to claim "I did not do it" the prosecutor probably won't believe it.

If you decide to go yourself just ask for mercy and state it is your first time, you are supporting a new car, you didn't realize how easy it was to drive it fast and you will be more careful in the future. You can always ask the judge to reset the case for a lawyer if the prosecutor is not willing to offer you a good downgrade.

Good luck with it. Take a picture of the car to show the prosecutor, who knows maybe he likes the BRZ and will give you a break for that...

No, I am not 19. I'm actually turn 25 this year. The 19 year old comment was just a joke. lol

I'll probably go with a lawyer. I see no reason not to. I'm almost certain I can fight the points, but I hope the fine gets reduced too. I don't think the latter is going to happen.

I'll keep you guys posted, but the result of this won't be for at least another month due to court date and what not. The judicial system always seems to move like a snail in my eyes.

I don't know the law in NJ, but here in CA there are certain situations where speeding tickets can be tossed out when speed surveys have not been conducted on multi-direction roads within a certain number of years.

Also, does NJ allow you to ask for a continuance and request a trial by written declaration (most police hate having to do extra paperwork)?

Just some things that may help you...

If that's what you liked best I didn't tell the whole story. The daughter's mom was my math teacher; a real bitch. Oh, and it was her first time. I felt as though I won the matter, and isn't that all that really matters?

Just finished my court appearance. Judge deducted my points down from 4 - 2 only and fined me as well.

Anyone knows if 2 points will increase your car insurance?
