Class Action Lawsuit

I like many others have followed Subaru's Survey, Pre-Order deposit procedure. I think we all agree that it has been an effort in futility for the most part. I pre-ordered my car on march 7, and I just finished a week of conversation with SOA. They still say november ever though there are cars
for sale at other dealers.
I intend to contact my local TV consumer advocates to see if media attention will help in any way.
I was also wondering if anyone feels the pre-order process might be in violation of contract law. Class action suit. They should be forced to fill pre-orders first! Any attorneys out there have a take on this approach?

Cool your jets children! Nobody is filing a lawsuit. Just venting my frustration with this process. I have always found as much satisfaction thinking about getting even as doing it. Maybe more. And I couldn't agree more about the sue happy in our society. I also think those of you that are lucky enough to have your car should shut up and go drive your car.

lol are you serious?

The process was described MANY months ago. The process is the process, if you had a problem with the known process then you should have purchased the car from a large volume dealer in the NE, or gotten on the list first. It's not Subaru's fault that you wanted the car early but didn't PLAN for that very well.

Unfortunately a pre-order is not generally a contract to buy, unless specified. If it were, this would be a two way street, people that dropped out would be subject to recourse. It may not be fair, but it is what it is and I agree that it not fair, it is not illegal.

Sorry that you had to wait... but at the same time, you're not the only one that have been waiting for this car. All those ppl are waiting patiently.

If this law suit goes and slow down the production MORE, then all the patiently waiting ppl might take a class action law suit against you.

Or it could be worse, it might end up stop selling it in US.

Again, I know SOA & some dealers are no help, but wait patiently and avoid taking action that effect everyone (in bad way).

i think you are too slow for putting down your pre order. i put mine down on pre-order in late Jan, followed up on March 1 open order date. got mine on memorial day, which is earily for their earily june prediction.

from my dealership, prior to march 1, there were already 20+ preorders. so you comming in on march 7 with a nov delivery date is expected.

personally i think their pre order processes is fine. this is one of those things where you snooze you lose. its no one else's fault but yours.

i hate the sue happy people like you who think by sueing it will makes things better. well, it wont.

now, if you cant stand the wait, go for a scion, or a G coupe
and stop FU(King it up for everyone else.

Not really. If it were 1/2000 and was stopped due to a CAL might be a bit different than the company stopping production.

Give it a shot.

Some preorders are a contract to buy, you just have to look at the *contract*

There are many people that don't have the BRZ that would jump on the bandwaggon. All you could do is present it to a lawyer, he'll do the research, and if it seems like a good chance that the case is a win and he will make at least 1/3 of the settlement amount he will then take the case. Keep in mind you'll probably get 1/10th back for every dollar you deposited.

I believe Subaru of America could have done things differently, but the problem is the dealerships for *MOST* people, not all people.

High volume dealerships as someone mentioned is a very good idea. That's what I did. In the end, I lost my job and just started a new one so I didn't have the funds or stability of income. I need to make sure I'm still in this job a year from now and that my income is stable before I purchase/preorder a car.

It was very important for me to get in clear writing on my preorder contract that the deposit is refundable. Thank God I did that. I could see someone being so excited that they know *no matter what* they are getting a BRZ and don't need the deposit refundable but life is unpredictable. Jobs, health, death of loved ones, etc.

Make sure your deposit is refundable. Then search your region that still has the BRZ in inventory. Get your deposit back and snag the one you find, the one that is coming shortly, or the one that was a cancelled preorder.

lol what are your damages? You can get your deposit back... if not that's the dealer's policy and not Subaru's. And like you said there are others available around you. Go buy one of those.

Leading up to the release of these cars, I read quite a few news stories about how the BRZ's would be hard to come by. Why don't you just go buy an FR-S or BRZ that is in stock somewhere?

Not sure how others are being served by this pre-order system, but I placed my pre-order on March 1st as did a lot of us here. I waited and waited then my dealer called on May 19th and said car would be here June 11th.

On May 28th dealer called and said car was delayed and would be in on June 18th. Then out of the blue I get a call June 6th to say car just arrived.

Needless to say I'm a happy camper! Car went home on June 8th.

I was number one of one at this dealer. Since then they have had an order placed by another customer for a Limited 6MT WRB and that car is due in sometime in July.

Not sure why others are still waiting. My dealer is pretty small and in a smaller urban town.

Do you have any car that you know that CAL stopped the production? I can't think of any. Cuz company make some excuses to make it sound like company is the one stopping the production.
