Rear ended today!

So I was sitting at a red light today and a lady rear ended me in her Nissan. It totally caught me by surprise as I was looking straight ahead waiting for the light to change. I pulled over to the side of the road and the lady immediately started apologizing. I asked her how this happened and she said she looked down to adjust her heat. My neck was pretty sore and I went to the doctor to get it checked out.

Now for the important car info. The damage didn't look too bad from the outside. Upon closer inspection, you could see the rear end got pushed in making it difficult to open and close the trunk. The trunk also did not line up with the bumper as it did before. I wanted to take it to Artistic Autobody but I live on the east side so I went with Fix Autobody on Stark. They got pretty good reviews on line. Not sure what it is about our cars and getting hit. Maybe they like them so much that they just keep staring and get mesmerized. Haha. I think she was on her phone and didn't want to admit it. I just hope they repair it correctly and replace all of my aftermarket parts. BTW, the guy at the autobody shop did say nice car.

Thanks. Will do. This shop has a good reputation so we will see. In the mean time, I will have to see what this Chrysler 200 has got. Haha.

Consider legal assistance

If you're experiencing pain or discomfort in the neck area, you have whiplash and even if you do PT for the short-term, there is a chance that you'll have problems in the future. Go to your own doctor for the evaluation. If the insurance wants you to go to "their doctor" - do that after you get your own independent evaluation (i.e., your doc). Same thing if you consider what is below....

As much as I hate to even discuss using lawyers, you might want to consider this IF the current pain and discomfort is to a moderate to high degree. When dealing with Personal Injury attorneys, do your homework, and try to find a reputable one that won't charge you "expenses" while they handle your case. Typically, they will get 33.33% of any settlement and expenses would be deducted from the settlement. If you go with someone and agree to "pay expenses..." while the work is being done (which could take months), you'd be on the hook for those $$ regardless of if you "win" the lawsuit (i.e., you might loose... get no settlement $$ and still have to pay the expenses to the attorney).

If you go this route, remember, the settlement is made up of two parts... the fixing of your vehicle (property damage) -- and -- medical. The property damage is pretty cut and dry. The medical... well that is where it gets sticky b/c it is to the attorney's advantage to rack up as much medical costs as possible. More medical $ = more settlement $ (total medical costs is multiplied to account for "pain and suffering"). So, if medical costs total $1,000, lawyer might go after insured's company for $2,000 (and get 33.33% of that). Don't expect much in the way of "EXTRA $ for pain and suffering..." unless you end up with really serious medical implications that preclude you from working or enjoying life (e.g., fracture vertebrae = "I can't water ski ever again on the basis of medical evaluations... and this is all b/c your insured rear-ended me... blah, blah, blah...).

Thanks for the advice, it is greatly appreciated. I was involved in a pretty serious motor vehicle collision at work about 8 years ago and messed up my neck pretty good. This time it wasn't nearly that bad and the pain is about a 2. I hate dealing with attorneys and unless my pain gets worse, I will stay away from them. My doctor gave me a referral for massage therapy and I will give that a go. I spoke to the adjuster today and informed her of what is going on. She is cutting me a check to reimburse me for my expenses yesterday understanding that I will have further expenses to be covered. I'm sure they will want me to close this case as soon as possible but that won't happen until I am all done and healed up. BTW, the Chrysler 200 does kinda suck but it was better than a Kia or Hyundai.

My advice would be to get your insurance involved and document everything. Her giving you money directly is a little strange. Her insurance should be covering EVERY expense you have. Your insurance is your attorney and they will recuperate any of your deductibles. Let me know if you need any advice some just someone to run things by before making any decisions.

I would definitely contact a lawyer. They will help you navigate the whole medical issue, especially having a previous, similar injury.
