Nope!! His shoes fell off, noggin smacked the ground, body bounced and body curled up in a fetal position! It's as real as it gets! I remember watching an episode on mythbusters about the shoes falling off and how much is need to knock a person out of his shoes.

1. most likely the black car didnt even know there was a stopped car on the road because the RAV4 was blocking the veiw(things get smaller in proportion to distance
2. most people dont expect stopped cars on a busy freeway to be ON the freeway still
3. the black car had plenty of room, he wasnt speeding, both the camera car and RAV4 were braking and the black car didnt expect the RAV4 to come to a complete stop(every time you see someone go on their brakes on the freeway, you expect them to trim 3-6 mph and 10-12 mph at the most), so the black car appeared to be speeding when he wasnt....
4. when someone stops short in front of you unexpectedly, you have a split second to chose right or left lane, sometimes you dont even have time to look for a car next to you in that situation, the wreck would have never happened if those kids were on the side of the road...

Both 1. and 2. are true.

As to 3, if the black car was not speeding, he must be reacting too slowly, or did not have the intention to slow down. When the filming car and Rav 4 were braking to stop, even before hitting the van, the black car should have enough time to stop if he reacted at the same time. Unless the black car has less braking power than Rav 4.

As to 4, I would say the driver of the black car simply does not remember his surrounding during driving. Why, just based on the start of the filming it seems that the black car is at the blind spot of the filming car, or behind. So imagine if you were the driver of the black car, you are going and then the car in front of you (Rav 4), and the car on your left (filming car) are braking suddenly. You braked or tried to run around it. Why on earth would you choose to steer left, and you know there is a car on your left prior whereas there was no car on the right?

So, there are two things here: the driver of the black car reacted too slowly so he could not stop completely, and he did not remember his surrounding situation and chose the bad route. That put him at 100% at fault.

About the last statement, even if the kid is at the side of the road, that does not guarantee he will not get hit all of a sudden. There are so many videos on YouTube that office walking on the shoulder of a highway and got hit by reckless drivers who do not yield to the left lane...

My "fakedar" always goes up when I see something like this. Why was someone actually filming is always my first question.

I'm guessing since someone earlier noted that the person only broke his legs this was a true event, it just seems odd.
