Probably on the phone, but I don't think you can blame it all on the driver. Getting out of your car on the highway is NEVER a good idea. Just stay in the damn car and wait for the cops.

It's a 1-2 TKO!! The guy in the van with the hatch open got hit by the SUV.

How dangerous/dumb is it to also stand in the lane! At least run to the shoulder when the coast is clear and leave the cars there with the hazard lights on. Get out of the flow of traffic and let the person driving pan ahead. If they couldn't scan ahead to see a car stopped on the road, that is their fault.
