I wasn't referring my comment so much in this case and to what people have left. More so in general. Every time there is a high profile case on TV everyone shouts 1st degree Murder, and in fact its not and they get off, but would not if the charge would've been 2nd degree or manslaughter..

in this case 2nd degree murder would fit the crime, the old man fired the gun knowing he could've killed, but did not sit there in wait planning to kill..

Seriously. I've done that for people parked in front of my house. Shooting them would have never even entered my mind.
