Does anyone know why they make (separate part number, etc) different exhaust TIPS for the USDM market, but the rest of the world gets the JDM tips? It's not like it's a different exhaust, and we get the same rear bumper valence size.

So, wth, Toybaru?

Different rules about how far out the exhaust can be from the bumper. My understanding is that instead of making a shorter version of the jdm tips they took the lazy road and grabbed some tips from another subaru and threw those on.

Correct. The JDM exhaust tips didn't pass North American laws. They stick out past the bumper so if someone were to walk behind your car and rub their leg on it, they run the risk of burning themselves. It is a stupid rule but that's the story.

So the USDM tips are actually 3rd generation Subaru Forester tips. Silly enough, I believe the Forester is made at the same plant as the BRZ/GT86/FR-S. So they literally rummaged through the parts bin like mentioned above.

I do not think this law related to having JDM tips (as in I don't think a cop is going to fine you for them). But they definitely can't be sold like that.
