I'd bet tonyen is familiar with the sued, lol what assets, bankruptcy, rinse, wash, repeat process.

Clearly he's went though multiple lemonade stand business ventures and even goes by a different name.

To assume he isn't familiar with being a snake when sued would be kinda silly.

Ah, yes, but if FRS300's state has statutes similar to Ohio, then you're dealing with statutory violations. That's a whole other ball game than common law torts - with minimum damages on each violation, triple damages in some instances, etc... In my personal case against a shop (not that case I described above), the statute enabled me to sue for 20 times the amount I paid the guy... which quickly resulted in a settlement of 4 times the amount I paid the guy.

Your and anyone else's mileage may vary.

And like I posted the other day.

You can't get blood from a stone.

If he knows how to hide assets and show his income is nothing and **** then civil court won't do a damn bit of good.

Considering his past history it would be silly to assume he hasn't allready been down this road.

Ever heard of a debtor's exam?

Ever consider that a judgment is good against future income?

Are you an attorney?

Your approach to this based on assumptions and calling it "silly" almost makes one think you must be friends with the guy or something.

Circumstances may or may not make it worthwhile to pursue a civil suit - and that is true on a case by case basis. But to act or fail to act based on assumptions is never really a good idea, IMO. If that had been done to me, I'd certainly be pursuing something - but then I can do it without retaining counsel. FRS300 cannot - it's going to cost him for counsel one way or another (either initially or when the case is over)... unless, of course, he'd choose to file it himself in small claims court (in my state that covers up to $15000 in damages in some cases).

At any rate, if the shop owner has been in business for awhile and is still in business, then I'd be more concerned about him having high debt and then filing bankruptcy after I obtained a judgment than I would be whether or not he knows how to "hide assets".

Wouldn't be that difficult to determine if he has been sued before. A search of the court clerk's office in the county he's located in would be a good start as most cases have to be filed against the Defendant in the Defendant's county (at least in my two states). Many court clerk offices even have their docket online... which would allow such a search without even leaving the house.

So, FRS300 can take your advice and assume that the shop owner has been sued before, assume that the shop owner knows how to hide assets and assume that the shop owner can show he has no income... OR

He can investigate. I know what I'd be doing. But FRS300 will have to make that decision.

I deal with deadbeat tenants.

A judgement in this state against a scumbag is about as useful as shitting in your hand.

Scumbags know the system. They know how to work it.

It's a safe bet considering the history of businesses, bankruptcies, arrest, name usage, and past forum history on other platforms that doyen knows how to work the system. He has quite a history that was posted and deleted in past threads.

I fully encourage taking legal action, but don't expect it to net a goddamn thing when it has Allready been shown that he has about a 10 year history of screwing people with different shops and auto platforms on other forums. The safe assumption would be that he's been down this road before.

Which is something the only lawyer here has mentioned in basically every post. They will not be moderated for on topic discussion.
