So basically the whole deal is fucked huh? I would try to get a new car like some of the other people are saying, lemon laws should apply to you if you can provide documentation, of course.

Maybe, depends on the work. Changing the oil, mounting tires will likely be no problem, might be an uphill battle to do anything more serious like fuel pump replacement or DI replacement even though they're mechanically identical.

And of course you'd be paying out of pocket for all of the above, Subaru is not going to pay for warranty work on a Toyota product. It doesn't make sense, might as well give out free repairs on Nissan's or Chevy's at that point.

Sounds like you'd be better off with an independent mechanic/enthusiast shop but just like dealerships it's still tough to find good ones.

Soo I think toyota is trying to pull something.... soo I went to toyota to see what's up with the car since they haven't called almost 3 weeks and they said toyota techs looked at the car and parts are ordered... The sketchy thing is that I asked so what caused this they said Idk. yet If they did not know what caused it they cannot determine who's fault it is, mine or theirs. I don't think a dealership would replace the engine without knowing for sure that it is their fault

Did you call Scion corporate?
Did they send the engine back to the factory for investigation?
Did they supply you a rental?
Are you asking for compensation in the form of a couple payments made since you don't have your car?
Did you contact anyone about a lemon claim?
These are the things you need to be doing. They can investigate the cause after they get your car on the road. Seems they may be thinking it's something you did and are making 100% sure before they try and make you pay out of pocket to fix it. Just my $.02.

Yes to all the questions they told me today they are not at liberty to say what caused the engine failure and they said they pit in 18 K worth of parts

When you bought the car you should of received a warranty information sheet, in there you should see a sheet that states what to do in each state. Look it up and see what it says, I know in California it states an attempt to repair it within a reasonable time and they have to attempted to repair it a certain amount of times. I would say 3 times is it and now the engine is destroyed and if they state the cause was the code I would go for the lemon law. You will get all your money including all interest paid when you win.
