Subaru's warranty is just like all the other auto. mfg. warranties when it comes to "operating the vehicle in any competitive or racing event." Damage to any component is not covered.
Drivers education events on track are ok since they are not competitive or timed/racing. Except Subaru's warranty does not cover damage caused by "extreme temperatures." Which means we should not go to any hot weather D.E. events and only go when the air temperatures are below extreme. |

Considering the cat damage likely occurred at the same time and as a result of the engine failure that was experienced, does this really need it's own thread? Just merge it with the other one...

I don't think many people are left arguing that Subaru is legally in the wrong, the vehicle has been used "off road" in conditions that promote premature failure of parts.
We can all agree it's a shit thing to do (deny warranty that is): it wasn't racing, the vehicle wasn't modified, and Subaru has promoted this vehicle as a performance car that is up to the rigors of enthusiast driving. |

I am pretty sure Subaru is saying this because they denied the warranty claim for your seized engine. If they honor to warranty any other part on it, they know that a good lawyer could easily turn that around on them, and point out that if they warrantied said item, there is no reason they can deny the engine warranty.

The service writer who wrote up your engine r&r needs to add the catalytic converter as a failed part due to the initial engine failure.

And they still are not honoring it? The dealer should do a make good for not recognizing the catalyst failure during the engine failure warranty work. They made more than enough off that job to cover the cat replacement.
