I have read all that and I am still not convinced that having your car plastered all over the Internet on the track is helping your cause. Not trying to be a prick, and not an attorney. At this point if I was you I would just turn everything over to an attorney, follow their advice and go from there.

Like I said, I am in your corner, I think Subaru should 100% step up and replace your engine. But it is pretty clear at this point it is going to take legal action on your part to get the car either fixed or Subaru to buy it back so you can move on.

Maybe they shouldn’t promote it as being a track car, but I still don’t feel like they should be on the hook for everyone who blows an engine as a result of driving on the track.
Was this a result of track driving, or a manufacturer defect? Probably the defect, but made much worse by pushing it hard at the track. Under normal driving this might have been a simple repair as opposed to a catastrophic failure.
So where do you draw the line?...

Since the OP contacted Subaru before the problem became catastrophic, and Subaru was entirely unwilling to even look at the car until it was throwing a CEL, and it didn't throw a CEL until the engine was already dead, it wouldn't have mattered if the car was slowly puttered around town.

I'm scared to all hell taking the tachometer higher than 5k after reading this whole thread. Toyota/Subaru need to man up and fix this crap. It makes me miss all my Honda cars now with their high-rev motors w/o major headaches.

If you own a BRZ, I can understand being scared. Thankfully, Toyota seems to be MUCH more forgiving, even encouraging of using this car on a track. My dealership told me to go for it! If something breaks, bring it in and we'll take care of it.
