The driver in the rear is always responsible because only he or she can maintain a sufficiently safe space from the leading car. With sufficient space, it impossible to hit the leading car - basic physics.

The driver in front cannot control the behavior of following driver, and thus the leading driver bears no responsibility.

Btw, sorry about the car being damaged and your wallet dinged, but I am very glad both of you are fine.

Yes but what if I just stop in the middle of the freeway? There is something to be said for leaving your vehicle in a place regular traffic won't be expecting it. In that case they are the danger.

It doesn't matter beause you, and other drivers, are responsible for leaving sufficient space. Btw, I learned my lesson by hitting a large chunk of concrete because I was following too closely to avoid it. If you hit a car stopped on the freeway, it is still your fault because you should not be following so closely that you cannot stop in time.

I know, I was responding to others' comments. I feel very sorry for you. I assume your baby is still new, and now it needs work, plus it cost ypu money and I imagine the entire situation sucks and will continue to suck for awhile. Fortunately, neither people nor cars were hurt.
