I had an interesting encounter with a state trooper once. I had left my friend's house after eating and had one beer. I waited about 2 hours to leave, but being Chinese my face was still flush and pretty red. I was completely sober but it's just what happens when I drink. On my way home I was pulled over by a state trooper on the freeway. He looked at my face and was obviously convinced that I was intoxicated. After making me do all the stupid balancing tests (holding one leg up and all that stuff), he made me do a breathalyzer test not once, but twice. It kept pulling up ~.002 and he finally gave up. All he said was:
"Well you passed with flying colors. I just don't understand why you're so red. My advice would be to just not drive at all if you plan on drinking." I think to save face he also said he was going to let me off with a warning for not having a front plate. He looked legitimately confused after the breathalyzer.

For all of those who believe in the whole "innocent until proven guilty" thing, just get charged with a crime and let me know how it works out for you? The reality is, we live in a society that says one thing when the reality is "you're guilty until proven innocent".

Well, I would say It's too easy to "prove" guilt, or rather people are too easily convinced. But you are right that just being arrested/charged with a crime can have serious consequences.

I've known a few people in my life that have had their lives totally changed because of a charge that wasn't warranted. For example, just imagine if the OP had been arrested by the officer. He was walking through a nice neighborhood late at night, "fit the description" of a suspect who had been involved in an assualt, had alcohol in his system and is a minority. What do you think the DA would have done? My money is they would have charged him. At that point, he'd have three options. Plead innocent and go to court, take a plea or plead guilty (techincally he could also plead "nolo contendre" but usually that's for people who have worked out a plea bargain). No matter what option he chose above. all would involve him having to attain a criminal defense lawyer (read lots of money if you want a good one) and his life would be changed forever. At the end of the day, he has to prove his "innocence" or get a conviction for something he didn't do.
