It is going to 100% go against your insurance. Did you get gap coverage? There's a good chance your insurance will go up.

The other guy drove off? Yeah man sorry, you're going to have a hard time fighting this one. Unless someone saw it and is willing to say something to your insurance, I think its going to all be on you. Not that you want to ever get in an accident, but I think it would've been better for you (insurance wise) if the moron would have clipped you. Glad you're ok, make sure you go to a doctor and get checked out!

Your insurance company is going to look at it as a single car accident given that you didn't make contact with another vehicle. Additionally they are going to question why the police weren't called.

I don't understand what you mean by only having 400 on your loan. Is that your monthly payment? Or is that the balance left on your loan that you owe the bank?

The first step is going to be finding out what the damages are appraised at. Has an adjuster/estimator come out to look at your vehicle yet?

hope you took lots of pictures and got a police report.

It'll likely NOT get totaled, but airbag deployment is pretty serious in eyes of insurance.

Make sure you file a diminished value claim if it isn't totaled. If it is totaled, fight for amount you paid for the car.

You sure they didn't clip the tail of your car as you swerved away to avoid them? That would have put you in a spin easily and hitting the wall with that corner would have hidden any impact damage they might have had when they clipped you. If so, file hit and run police report with vehicle description and tell your insurance.

If they didn't make contact and you spun out on your own - if your car is totalled, depending on your deductible, you might get $23k back from your insurance (with a hefty increase in future premiums). If your car is pretty new and you didn't put a lot as a down payment, you might end up owing the bank money for a car that's not even yours any more. (If insurance totals it, the money they give you is in exchange for the car.)

Good luck. Remember its sometimes tough to recall everything about an accident as it happens so quickly. Sometimes you remember stuff days later when your mind has time to process everything.

what is diminished value claim? i total paid 30k, with 8500 trade in then split the rest of payments into 7 months
how should i do to fight for the amount i paid for my car
any help will be greatly appreciated

i believe i have 1000 as my deductible......and yes its fairly new, down payment was my previous car ($8500) , and i only owe the bank 400. meaning i have only 400 left in my loan. what should i do / say to fight for a higher pay off

400 is the balance i have left on my loan that i owe the bank. the adjuster is going to inspect the car tmr. and whats my next step? if he decided its totalled, what to do ? what if he says its not totalled, fixable? should i believe what he say or fight till he says its totalled

Are you in any way injured? I would definitely start by:

1. Getting a medical eval ASAP, even if you feel "fine" right now. Airbags went off, there's bound to be some whiplash or muscle strain fro such a hard hit.

2. Contact a personal injury attorney ASAP, tell them about the accident, and that you want to file a diminished value claim.

3. Follow attorney's instructions, sit back, get compensation in a few months.



A DV claim is the loss in value of your car which you can claim. A car w/o an accident is worth more than a car w/ an accident. Basically, you look at what a car would cost retail value before accident, compared to value after accident with repairs. That's a general estimate of the diminished value you could get. It's a bit more complicated than that, but that's the gist of it.
