I dont see why you would not want to take the time to get a lawyer and have this handled professionally.

A little missed time and inconvenience is worth far more than risking a $30K purchase.

The GM can and should take care of it, good luck. When I worked at a dealership, the GM is the last person after dealing with less than effective Service and sales people and will usually give the customer exactly what he wants to escape further escalation.

Again, good luck and be firm with him about this.

At a minimum, I like the suggestion of a new engine, rental car, and factory 100k/7 year warranty extension.


I would still have a lawyer look at any paperwork before you sign it. Protect yourself.

Why should he recieve more than he is due, at most it should be EITHER a new engine OR a 7yr/100k warranty. The whole people think they deserve more than they are owed like some kind of pain and suffering compensation is bogus.

They made a mistake, they should be obligated to do no more than to either warranty it for a long time or replace it.

Personally I would never ever be comfortable with the car again unless the engine was replaced completely.

In a normal car, a new engine would be a good solution.

But this is not a normal car. It has the potential to become a collector's car in the future, in which a matching numbers engine would be worth money. Swapping out the engine in his car doesn't make him whole, because he won't be back where he started before their mistake. Potential future loss in value is not something that can be quantified, however, so it would be difficult to get them to agree to it. Even so, I would have that in the back of my mind throughout any negotiations and would still be pushing for some other solution.

And if they did do an engine swap, I would try to keep the original engine as well so that it could stay with the car and be rebuilt and reinstalled in the future should the matching numbers ever become an issue.

Wishful thinking? This just another sub 30k dollar car from a non exotic company. It's also a full production car, its not like this is some kind of special car built in limited numbers. Also the remote possibility of an object becoming valuable in 20 years is not legal grounds for special compensation. What your talking about simply doesn't exist, right now its just another car on the road.

You are right though, it doesn't make him whole, it makes him BETTER than whole as he would now have a brand new engine, making the car MORE valuable than it was. Just ask an insurance company...when my WRX got totaled with 800 miles on a new motor they increased the value of my loss by $2500 because it had a new engine in it.

OP you are doing this the right way. Meet with the GM and give him a chance to make it right. If not then consider legal repercussions. I personally don't think a new engine with an extended warranty thrown in is asking too much. A replaced engine will show up on Carfax and it could be viewed as a negative in the future when you go to sell the car.

Clearly this is taking up a lot of time for you as well as stress it has caused for something that should have never have happened.

1st: do what you are doing. Keep negotiating with the GM and let him/her know that you will not accept anything less than a new motor and a rental car. It will be cheaper for the dealership to provide a new motor than a new car.

2nd: if that fails .... as much as I despise attorneys .... get one. The attorney needs to write a letter to show that you mean business.

3rd: in my city .... the local TV news depts/local papers will investigate business' that have screwed their customers. Contact them with your story.
